Yet despite multiple court defeats, Ohios Republican Secretary of State Jon Husted is determined to restrict early voting as much as he can get away with. Indeed, Husted openly defied the first court order blocking the Republican restrictions on early voting, although he eventually backed down after a federal judge ordered him to appear in court personally to explain himself. Now, just two days after the conservative Roberts Court turned away Husteds bid to reinstate the anti-voter law, he is still finding new ways to cut back early voting:

(53,521 posts)Large parts of the South are little theocracies. Republican politicians routinely flout election law. American citizens in Yemen and elsewhere are shot down by drones without a trial. If you are called a terrorist you can be locked up indefinitely or even killed. City governments send in the riot police when ever the 99% dare use their right to peacefully assemble. BP gets away with polluting the Gulf of Mexico. Gas companies poison groundwater with fracking chemicals.

(6,819 posts)During the 1950s, when segregationist officials tried to prevent the enrollment of Black students after Federal court decisions, Pres. Eisenhower sent in "Federal Marshals." However, there were almost no real Marshals available. Therefore, they quietly deputized almost every Federal employee in the State to be Deputy Marshals for the week, and were given armbands that said Marshal. Most were actually postal workers, some of whom showed up in their little Post Office delivery vehicles.
Ohio sure has bad taste in Secretary of States. Many people blame Ken Blackwell (a republican African-American) for potentially stealing the 2004 election from John Kerry.

They get away with bloody murder because they know if Dems try to respond they'll be accused of being...fascists, totalitarian, a mob of angry black men (just fill in the blank). And it sticks! By contrast, the Rs truly are a mob of fascist, totalitarian, angry white men...because Dems are terrified to call them out on it. Imagine if Pelosi had gone after Rove. Of course she stood down like a good Democrat. Now imagine if the shoe was on the other foot. We know what the Rs would do. And the Dems would serve our own up on a platter a la Anthony Weiner.

The case was about whether a new law cutting off voting at 6 PM for all voters except the military was unconstitutional, because it discriminated on the basis of military membership without a justifiable reason. A preliminary injunction was granted by the lower court. Basically that means the law cannot go into effect because the court decided the law was probably unconstitutional and enforcing it now (before it is completely reviewed) would do irreprable harm.
That means the law goes back to what it was - which permits in person early voting through Monday. It does not (and never did) require all day extended hours on all three days. He is in compliance with the law.
Yes - he is being a royal, first class, jerk. Yes - he is trying to limit voting. But no, he is not in violation of the court order.
There are two very real threats from Husted that I have not seen discussed (outside of my mentions in other threads). The Obama team is aware of them, and has devised a plan for the first one - I haven't heard back about the second.
1. For the first time ever Husted mailed absentee ballot applications to every registered voter. As an (officially appointed) observer, I have witnessed many early voters come in to vote, be told they could not because they had already been issued an absentee ballot. They swear up and down they hadn't. Some of them interpreted the application as a requirement to confirm their name, address, etc. and believed they had to return it or be purged. So they returned it - accidentally requesting an absentee ballot. The ONLY way they can vote non-provisionally is by taking the ballot they received by mail to their board of elections to cast it. I expect this to be worse on election day, when taking the ballot to the board of elections after showing up to vote will be a hardship.
The law is clear about requiring these voters to cast a provisional ballot. What is unusual is that every single registered voter was sent an application, unsolicited. Given the real fears about voter purges, many voters misinterpreted the mailing as something they needed to complete and return not realizing they were requesting an absentee ballot.
2. Husted issued a directive that any absentee voter who fills out the ID envelope incorrectly must come in in person to correct it. So - if grandma is down in Florida, or son is away at school - and uses the wrong number from the drivers license (there are two numbers, and mistakes happen frequently about which one to use) - and cannot come to the board of elections in person - their ballot will not be counted.
If you are in (or know people in) Ohio - make sure that you (or anyone else) who requested a ballot (deliberately or accidentally) returns the ballot you received to the board of elections. Once your request for an absentee ballot is filled by the BOE, it is the ONLY non-provisional opportunity you have to vote - and provisional ballots are not counted on election day.
If you are voting absentee, double, triple, quadruple check that ID envelope. Have a friend check it. If it is not correct, you cannot correct it by mail.
