but he sure as hell won't leave under Obama as long as he is breathing.

Now would be a good time for Justice Ginsberg to get some well deserved rest. Although, I think she is holding out to write the opinion that declares DOMA unconstitutional.

6. Beating Romney was hugely satisfying...

But to me this is the major story of Obama's re-election. I shudder to think who Romney would have appointed to the SC if he had been elected and the opportunity presented itself.

Nope, don't even want to think about that.

Ginsberg and/or Kennedy and/or Breyer, which would basically leave the court the same as it is unless Kennedy is replaced by someone more liberal. Any rethugs will either need to be impeached (Thomas) or rolled out in a hearse (Scalia, Roberts, Alito) before they go anywhere.

So if anything, at least we get another 4 years of rightish status quo vs loony bin fascism.

10. I think it will take serious illness or death for Scalia to leave

And if that happens, Thomas will leave as well because he won't have anyone to tell him how to vote.

12. Look at it this way: Scalia, Thomas and Kennedy (he wrote Citizens United and voted against ACA)

2, maybe 3 would have retired this term if Romney had been elected, paving the way for 2 or 3 late-40s; early 50-year old conservative justices. That would have been a fucking nightmare. And Ruth Bader-Ginsberg is likely to retire too? My God, it would have been Elena Kagan, Sonia Sotomayor, and Stephen Breyer left against six fire-breathing and (relatively) young conservatives!

With luck, Fat-boy Scalia will have a heart-attack (and survive - I'm not an asshole here! and retire, Kennedy will call it quits...We could have maybe 3 new young liberals to the court?

But Scalia is so in the tank you may have to carry his fatass out in a body bag.
