The trial court will apply it, find no immunity, and Trump will appeal. Best case scenario is that Jack Smith seeks another expedited review at the Supreme Court level and the Supreme Court grants his request this time.

Worst case scenario I see it working it way up through the courts for another 3-4 months before the Supreme Court stamps the trial court decision.

Of course, this would delay any trial past the election.

Just my gut.

2. My bet is they will send it back to the district court, and there won't be any trial before the election.

Anyone listening to the questions from the Conservative judges, I don't think would be too optimistic.

These justices trashed the grand jury system, couldn't discriminate between official and non-official acts, implied that the special counsel is simply political retribution, and even offered that the time may come when a President decides to pardon him or herself.
