Mother Outraged After Middle School Teacher Exposes Confidential Medical Records


(NEW YORK, NY) - The mother of a seventh-grade student has filed a Notice of Claim with the City of New York after her daughter’s teacher displayed private medical records for the whole class to see on an overhead projector. Outraged at this breach in student-teacher confidentiality, mother Chanel Clark has retained attorney Frank J. Cassisi of Mineola, NY to sue the school district for negligence and to help her daughter be properly classified with a recognized handicap.

12-year-old Caress Clark was publicly humiliated in front of her peers when science teacher Benjamin Lewin placed documents from her psychiatrist on an overhead projector. Caress has a learning disability, and attends therapy twice a week for emotional and behavioral issues. She has been humiliated and teased as a result of this exposure, and both her and her mother have reason to believe that Lewin’s actions were intentional and/or with reckless disregard for her confidentiality, due to the nature of her behavioral issues.

“No student should be made to feel targeted by the very teachers that are supposed to have their best interests in mind,” said her attorney Frank Cassisi. “These children are often the voiceless victims of bullying and humiliation, and they need someone to provide a voice for them to ensure this does not continue. Such conduct should not be exhibited by teacher in a classroom as a tool for maintaining discipline.”

7. Special needs kids have to furnish medical/clinical documentation to get services from the school.

It's not unusual that copies of these would be available to teacher.

The rest of the story makes no sense at all which is why I counsel people to withhold judgement.

12. I've never received comprehensive records from any student's doctor.

Usually we just get a letter saying 'so and so is under my care' and/or listing prescribed medications. Nothing the other kids would be able to read and understand.

This story is bullshit.

What possible reason could there be? I want to hear why it even occurred to the teacher to do that.

... That will likely protect the school somewhat but they might still settle to make it go away.

The teacher, on the other hand, better have liability insurance (assuming the article is accurate).

The facility the test were done in, the doctor that did them, and the teacher that released them along with the school. The fines are astronomical and they deserve to pay!
