Impeaching Scalia

IMPEACHMENT RESOLUTION

Whereas, Supreme Court Justice Antonin Scalia was the guest of a Kansas law school two years ago and went on a hunting trip arranged by the school's dean within weeks of hearing two cases in which the dean was a lead attorney.

Whereas, Supreme Court Justice Antonin Scalia and one of his children were guests of the Vice President on Air Force Two and then went hunting with the Vice President, shortly after the Supreme Court agreed to hear an appeal of a decision against the Vice President.

Whereas, Federal law provides that any justice shall disqualify himself in any proceeding in which his impartiality might be questioned.

Whereas, the American Bar Association Code of Judicial Conduct provides in Canon 1 that a judge shall uphold the integrity and independence of the judiciary and, in Canon 2, that a judge shall avoid impropriety and the appearance of impropriety in all of the judge's activities.

Whereas, Article III, Section 1 of the Constitution of the United States provides that judges shall hold their offices during good behaviour.

Whereas, Article 1, Section 3 of the Constitution of the United States provides that the Senate shall have the sole power to try impeachments, and no person shall be convicted without the concurrence of two thirds of the members present.

Whereas, by his actions, Justice Scalia has tarnished the integrity of the U.S. Supreme Court.

Be it resolved, the legislative branch of our government shall forthwith seek diligently to determine if there is cause for the impeachment of Justice Scalia.

Be it resolved, if the U.S. House of Representatives determines that there is cause for the impeachment of Justice Scalia and if the U.S. Senate by a vote of at least two thirds of the Members present convicts Justice Scalia, then in accordance with the Constitution Justice Scalia be impeached, removed from office and disqualified to hold and enjoy any office of honor, trust or profit under the United States.

We, the undersigned, urge the Members of Congress to show their support for the proposed Impeachment Resolution by signing their names.


BY SIGNING THIS PETITION, YOU ARE REQUESTING YOUR SENATORS AND YOUR U.S. REPRESENTATIVES TO DETERMINE IF THERE IS CAUSE FOR THE IMPEACHMENT OF ASSOCIATE JUSTICE SCALIA.

The House of Representatives shall chuse their Speaker and other Officers; and shall have the sole Power of Impeachment.


So, you are wrong about the Senate.

By the way, here's from Article I, Section 3:
The Senate shall have the sole Power to try all Impeachments.


That is where so many get this confused. The House impeaches; the Senate conducts the trial. Impeachment is like an indictment, not a conviction.

and I'm still signing the petition. ..." By the consent of the governed....". Scalia has a lifetime position and would eat baked rat with mouse sauce before he will leave the court of his own will; he, and the Chief Justice need to know , clearly, Scalia is over the line of acceptable behavior and comments as an Associate Justice and by his behavior and words is really starting to push the 'governed' past consent.

Because as long as the Republicans hold the chair of the Judiciary Committee, there will be no impeachment of any conservative. There may very well be an attempt to impeach Obama, however.

ruled in Bush v Gore while his son worked as a lawyer with the firm representing Bush demonstrating a clear conflict of interest.......
Whereas Justice Scalia has comported himself as a legal bully rather than an impartial arbiter since taking a seat on the highest Court, and as such blatantly sullied the image and reputation of the Court........
Whereas Justice Scalia has acted as a partisan hack rather than an impartial arbiter..........
And he should take Thomas with him for using the Court as a vehicle for monetary gain.
Supreme Court my ass, how about Mediocre Court.

Not sure, but because Justices are appointed and not elected it may only take a simple majority of Senators to convict, rather than the two thirds required for elected officials.

It's a 2/3 vote of the Senate to convict.

But that said ...

whereas, in the week following the High Courts decision to hear argument cases that will have a direct bearing on the rights of GLBT persons, Justice Scalia has, and continues to make, public commentary regarding homosexuality, likening it to murder and bestiality ...

Supreme Court Justices are almost god-like in that the recusal rules do not apply to them because there is no Court above them. Scalia can still be impeached for all of his conduct as a whole, but I do not think that in the eyes of 2/3 of the Senate he has done anything bad enough to be impeached. To be clear, as an attorney, I believe that his conduct has been reprehensible and an embarrassment to our profession. I believe that he has done more than anyone else on the Court in demonstrating partisanship and favoritism. His speaking to the Kochs for money, his ex-parte conduct on several cases, and his public comments, would each, individually, have caused him to have to step down if he was anything other than a sitting U.S. Supreme Court Justice! The rules do not apply to him, literally!

...he eats a lot of greasy food, doesn't take care of himself and hope age catches up with him. While a delicious concept (impeaching Scalia) but no way it would ever happen...especially getting a motion introduced into teabagger heaven: the rushpublican House. He's 76...and not going anywhere for now.

Unfortunately, the general public does not follow SCOTUS closely. We should have marched after Citizens United. The next time they screw us again we must try to take advantage. Each party claims to be against "Activist Judges" except when it is their Judge or Justice. If you have ever watched the movie, "...And Justice for All" with Al Pacino, that is how I feel about our system of Justice. Scalia is an insane elitist.

also I did try to view what kind of information is required. like name and address , phone number but could not get the link to actually work to access the signing part of this petition.

Also IMO it would look more effective with attorneys names and addresses on the letter.
Wouldn't ACLU be investigating this type of improper conduct and pressing the case.

Just asking.

Until there is political will to impeach Scalia, Scalia will not be impeached.

Conviction in the Senate is an even higher standard.

As much as I despise Scalia, he will retire or die before articles of impeachment are ever introduced in the House, even if the Democrats retake the House in 2014 and Scalia is still on the SCOTUS.

And he's even worse than Scalia. These people are criminals, and there are no rules governing their behavior on the bench, as there are for lesser judges. I think Congress ought to (but won't) pass legislation to apply the rules that govern other judges to the Supreme Court justices.

That is why he NEVER ASKS QUESTIONS of the attorneys arguing before him. Justices should be inquisitive and push the attorneys arguments, test them. Thomas just sits there and waits to talk to Scalia afterward to hear what he is supposed to do. Both should be impeached together!

Which doesn't have a ghost of a chance until 2014 and only if those who sat down in 2010 and turned the nation over to the baggers (see Texas, Michigan, Wisconsin, etc.) get up and vote, it won't happen then. It would be the right thing to do but baggers won't do the right thing. They want fascism and Scalia is their wing man.
Yes, he needs to go. Politics says he won't.
