They repeadly said congress was now in recess until the 22nd so I assumed that meant he could do it.

(36,974 posts)4. The thing is that The House normally will not agree to adjourment therefore...
without The House resolution agreement then The Senate can not go into an 'official recess' - and The Senate holds 'pro-forma sessions' every three days (which last only a few minutes), even though the majority of folks have left D.C. and have gone home.
This is how the republicans have been preventing Pres Obama from making any recess appointments
