On of the dirtiest little secrets on the labor front is the massive wage theft that now is more than epidemic, it really is pandemic because it is now considered "good business" cheating workers and cheating on taxes.
The dirtiest little secret in GOP run states in particular is that budget cuts leave no one on the job to police minimum wages, and labor standards. What was already in becoming a problem in 1998 when I retired is now totally out of control.
If YOUR EMPLOYER TAKES YOUR PAY, WITHHOLDS YOUR PAY OR UNDERPAYS YOU - you have no recourse to get your pay except to hire a lawyer and sue in court. The GOP and US Chamber Of Commerce do not believe that labor laws should be enforced and that they are bad for business.
The "Wage Theft Epidemic" post about "wage and labor" units being abolished is correct. The only trouble is that this trend began in the late 1990's. In Colorado, our wage and labor department was pretty much dismantled when I retired in 1998.
The complaints about over regulation put out by Romney et al is aimed at ending enforcement of labor law and labor contracts. The GOP will never never never pass any new minimum wage legislations except to get rid of it.
Wage and labor fairness is the last thing from the mind of the US Chamber and the GOP ARE NOT WORRIED ABOUT LABOR LAWS because they left no one to enforce these laws. Look at the NLRB there will be NO commissioners when the last one's term expires and the GOP will NOT vote for any new ones.
So let the games begin. If you work and GET NO PAY you might as well kiss that time good by. The worker has to prove that they were cheated and the company holds all the pay records to prove it.

(12,448 posts)Talk to an attorney so you know what you need and what is legal in your state. The go on until the amount justifies the case. When enough people stand up for themselves, we will see change. Until then, you are just a sheep to be sheared until it's time to slaughter you.

(10,602 posts)They also consulted a lawyer and were essentially told it would cost them more in fees than they would get in lost wages. Like age discrimination cases, lawyers will not usually take such cases even if class action because there is no money in it. I worked at DOL for 24 years. Workers are pretty much screwed now.
Also GOP is looking at raising age discrimination to 55. Worker rights are under assault all over the country. A lot is going on at the state level in GOP states or where the GOP has enough power to cut budgets.
Under sequester at DOL enforcement will be the first to be effected if it happens.
I do agree to document what is going on. But I do believe the day of enforcement is coming to an end unless we start voting more pro labor candidates.
The only cases I noticed that effected employer were huge cases like Walmart. Even if they pay back wages there is little to stop them because they steal wages in so many ways they get away with a larg part of it. The subcontract a lot of work where it is almost impossible to catch them. And most subcontractors are fly by night operations.

Speak to an attorney when the offenses first begin, then document, document, document until the numbers add up. Then you sue.
If you're going to be raped repeatedly and over a period of months or years, you may as well keep track so that you can collect at the end.
Smart phones can take and send pics of your time card, record and send conversations, document reports and paychecks, etc. Build you case over time.

(10,602 posts)The company my friend was working for was running more than one set of books. His pay info was online and was limited. He was locked out when he quit. The company had all the records and you cannot get them released.
The same problem exists with age discrimination. The employee must prove a pattern of discrimination. And it is almost impossible to do that if the company holds all the personnel records. And court cases can drag on for years.
It is really a mess right now because of all the mayhem. A lot of the dismantling started in earnest after Reagan was elected. The Reagan administration and subsequent 1st Bush administration had a lot of time to salt federal agencies with their people. Clinton was on the defensive when he took office. Then you had 8 years of Bush and they salted conservatives into civil service with a vengeance.
That is why Obama is having trouble because most of the moles still exist in key areas as mid managers and supervisors. You can stop or sabotage a lot of things in these agencies. Some of the failures in federal agencies I am sure are sabotage of operations.
You should see things from my vantage point with 24 years at DOL and programs. There is hardly any federal program that has not been compromised or damaged now.
Finally, what amazes me is how many GOP controlled states are just absolutely trashing unemployment insurance and other key social programs. I am a vet and I believe their is a lot of sabotage in the VA system by GOP sympathizers.
I know that what I am saying is perhaps outrageous, but there are too many failures that do NOT add up. There are too many events that are totally out of character. Some of the most glaring failures are in the FCC and FAA and DOL.
