Does the prosecution have that on paper? If so, I have no idea why the defense would use the "she didn't say no" argument. What pisses me off is that they're being tried as juvies and the most that can happen is juvie jail until they're 21. They deserve much, much worse.

That's the deal, that date rape drug is a hypnotic, mixed with alcohol it just blocks out consciousness. She came to enough to protest but as anyone knows who has been anesthetized, she couldn't stay conscious.
