If neither, I would go to the top level person possible and let them know what is going on. Even if you still quit, maybe they will do something about the bully.

Condolences for your loss and sympathy about your mother (my Dad just went back in the hospital today on his 90th birthday).

If not boss make sure you tell HR why.

He did the same thing to two others. HR doesn't care. Everyone knows he's bully.
