backed the view that my wife's Federal Grand Jury they can't put her in a position because her jury duty would mean she would leave her client unattended.

(Now to continue) BUT yet they will keep my wife on the On-call list- basically a fill in when other people call off AND only for the days her jury duty doesn't fall on SO basically she will only have a chance to work Monday Friday and Saturday.
My wife is looking for another company to work for and looking into doing it freelance. She is also going to be talking to clerk in charge of her jury.
As for the Underemployment she unfortunately hasn't made the magic number of $3400 to receive unemployment benefits --Which makes no sense that IF one needs unemployment they should be able to get it. My wife has worked since getting out of college she's paid into the system and yet the system won't work for her when she needs it the most.
About 2 years ago my wife got sick it ended up being a hernia that was ready to burst. While in the hospital after the surgery she developed fungal pneumonia and nearly died. She was on Oxygen for 2 and 1/2 months. When she went back to work she was on a part time schedule. Talking --long scripts--on the phones was hard on her lungs (she was in telemarketing.) Around January last year she got pneumonia again and the lung specialist that basically took care of her in the hospital basically wanted her out of work for 2 weeks to recover. She goes back and in February they let my wife go saying she wasn't reading her scripts in the right way.
It took her until August when she got with her current company to get a job. She was selected for Jury duty not long after getting hired and IT was fine UNTIL the past 2 months.
So this is where we stand. Any advise or help please.

(18,402 posts)I think your expectations are perhaps too high that your wife can be placed as a permanent caregiver when she is not available a number of days each week. Clients looking for a senior companion usually expect a degree of consistency with an individual, absent some unusual need (illness, etc.) that causes the companion to need a replacement. It's important for elderly people to develop a consistent relationship with caregivers, especially because often when that service is needed there is often some degree of mental deterioration that can make it scary for them to have different people all the time.
I think you need to make a decision here: beg out of the jury service and commit to the agency full time; or continue to accept the replacement assignments.

I definately feel your wife needs to bring this to the attention of the grand jury foreman and let the judge figure it out. I'm sorry that it won't do any good on the unemployment but it may give the cause for her to be relieved from jury duty.
As for the agency, that's tough. Over the last year, Act 22 which changed the way the state of PA reimburses agencies for their Medicaid Waiver consumers has had a huge impact on many providers (as well as AAA's). If your wife works for a small, mom and pop type, their barely surviving. Rates have been increased, but the damage has been done. There is also a parallel with state funding also, there has been no increase in rates over the last several years but costs continue to rise.
I'm just wondering if the agency your wife works for is losing consumers or is losing money to the point where they aren't making ends meet, but don't want to lose aides, especially ones that are reliable. I'm just wondering if your wife's supervisor isn't giving her a vague heads up?
