Mother of 4-year-old accidentally shot accused of child endangerment

RICHMOND -- The mother of two children involved in a non-fatal shooting incident has been arrested on child endangerment and gun charges.

Antonia Lynn O'Brien, 29, appeared briefly in Henrico Juvenile and Domestic Relations Court this morning and was ordered to return for a hearing June 7.

O'Brien is charged in connection with a Saturday morning incident in which her 4-year-old son was shot in the leg.

A second child, 10, allegedly located a gun in the family home and it accidentally fired striking the younger child, according to authorities.

More than 44 million Americans own firearms. Of the 192 million firearms owned in the United States, 65 million are handguns. Research shows guns in homes are a serious risk to families.

• A gun kept in the home is 43 times more likely to kill someone known to the family than to kill someone in self-defense.
• A gun kept in the home triples the risk of homicide.
• The risk of suicide is 5 times more likely if a gun is kept in the home.

Advice to parents

The best way to keep your children safe from injury or death from guns is to NEVER have a gun in the home.

• Do not purchase a gun, especially a handgun.
• Remove all guns present in the home.
• Talk to your children about the dangers of guns, and tell them to stay away from guns.
• Find out if there are guns in the homes where your children play. If so, talk to the adults in the house about the dangers of guns to their families.

For those who know of the dangers of guns but still keep a gun in the home:

• Always keep the gun unloaded and locked up.
• Lock and store the bullets in a separate place.
• Make sure to hide the keys to the locked boxes.

Also wanted to note there were about 50 million homes that have guns where this didn't happen today.

Guns, meds, knives, household chemicals - all are good things to keep away from kids.

Failing to secure a gun should not be a felony.

"If you have small children in your home, you shouldn’t have to be told to keep your guns locked up. This applies even more if the children aren’t your own. For example, I had a bachelor client who hired a woman to clean his apartment once a week. She usually brought her 4-year-old with her. Although the bachelor had no children residing with him, the visiting child gave plenty of reason to make sure guns were inaccessible."

"But what if you have a child who is under the statute’s arbitrary age of 16 but whom you are sure is responsible and knowledgeable enough to have access to firearms? This is hardly an unusual situation. For example, children are eligible for junior hunting licenses at age 12. They have to take the hunter-safety course, which includes firearms safety. Obviously the parents of these junior hunters believe the children can handle guns safely."

Obviously there are problems with enforcement of that (which the counsel discusses at link). A felony for not securing a gun is silly - charges stemming from what occurs because of that are another matter.

When the result of the failure is injury to others it most certainly should be a felony.

And the minimum sentence should be quite harsh.

If the gun is possessed illegally, the sentence should be double.

My nephew for one. Pulled over and had a gun in the car not properly secured according to state law.

Am sure you can find plenty more.

He was with his friend who was having a fight with his GF who got mad and called the cops and said they had guns in the car.

So pretty much that.
