Judge lifts ban on Texas’ abortion sonogram law

AUSTIN — A federal judge lifted the ban on the state’s new sonogram law Monday but warned in unusually harsh language that he believes that the abortion statute eventually will be seen as trampling on the rights of doctors to speak freely to their patients.

The state is still drawing up forms and rules on the law, but many doctors and clinics have anticipated the ruling and already have begun complying with it.

Doctors must perform an ultrasound and present the fetal image to a patient prior to an abortion. While the woman might avert her eyes or refuse to view the sonogram, the doctor still must describe all limb and organ development. Unless she lives a far distance, the patient then must wait 24 hours before she can receive an abortion.

The law provides that doctors can lose their medical license and face criminal charges for failing to carry out provisions of the law.

U.S. District Judge Sam Sparks initially held that the law — the furthest-reaching to be upheld by a court — unconstitutionally compelled doctors to “parrot” statements ordered by the state, even if they conflicted with the physicians’ medical judgment.

Bad enough to require a meaningless ultrasound on the pretext that 'the silly woman needs to re-think her silly decision', but the real outrage that should be communicated far and wide (but isn't) is the nature of this particular ultrasound - this is a highly intrusive, insert deep into the vagina ultrasound, so embarassing thatmany women will not have it done even when necessary. The Rethugs are just piling on to add insult to injury. I can't understand why they're not roundly condemned for it, except for the fact that people hear "ultrasound" and imagine the far less invase routine 'jelly on the belly' type.

What's more - the law is clear that no one can be required to undertake a medical prodedure against their consent. The Rethugs are in clear violation of the law by coercing a woman to undertake this unnecessary procedure against her will. This is truly an outrage, and ought to be being shouted from the highest rooftops. Bur in Texas...

No man is subjected to such indignities while trying to obtain legal and valid medical care.

I can't believe judges have validated the continuing abuse of women in this way.

If the women have to pay, how can the same people who push this law also hate the mandated health care coverage in the president's law. If insurance companies have to pay, maybe they will sue or refuse. My head is exploding from all this garbage!!
