"The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but Congress may at any time make or alter such Regulations, except as to the Place of choosing Senators."

The Voting Rights Act was 100% constitutional.
Congress can't "...at any time make or alter such (state election) Regulations" without the legislation to do so - and that's just what the Voting Rights Act was and did.

This law should have been written to cover EVERYONE when it was first drafted in the '60s. They ALSO had the chance in 2006 to cover EVERYONE. But they didn't. This isn't a new issue at all -- we've known this was a problem for 50 years now.
Now it's gone. Good job, everyone.

(3,731 posts)what you say is exactly correct, all congress has to do is revise section 4 to cover all states and the problem goes away.
Sen. Leahy has is already drafting a new bill to correct the problem and I expect it'll sail through the Senate.
