Judge temporarily blocks North Dakotas six-week abortion ban, calling it clearly unconstitutional
A federal judge in North Dakota on Monday blocked the states law banning abortions as early as six weeks after fertilization, ruling the measure cannot take effect until the legal challenge it faces is resolved.
The preliminary injunction granted at the request of the Center for Reproductive Rights means the nations most restrictive abortion lawwhich would bar abortions as soon as the fetal heartbeat is detectablewill not take effect Aug. 1, as originally planned. it also suggests that even as states across the country enact measures limiting abortion access, some of these laws may never take effect because of stiff legal challenges.
U.S. District Judge Daniel L. Hovlands ruling criticized the North Dakota measure in the harshest possible terms, calling it clearly unconstitutional under an unbroken stream of United States Supreme Court authority.
The State has extended an invitation to an expensive court battle over a law restricting abortions that is a blatant violation of the constitutional guarantees afforded to all women, Hovland wrote. The United States Supreme Court has unequivocally said that no state may deprive a woman of the choice to terminate her pregnancy at a point prior to viability.

I'm glad you don't listen to the GOP knuckle draggers who I'm sure try to make a lot of men who support us feel disrespected by their own gender as not being masculine enough, perhaps even adding the scurrilous charge that we are man haters.
News Flash, Santorum and Company! We LOVE these ethical men, because they (you guys) are the enlightened ones we can respect.

(23,156 posts)I'm well beyond the need for abortion access.
I also keep on wondering where the doctors are in all of this. I'm not assuming every doctor is willing to perform abortions, but every doctor who ever deals with women's health should be very aware of what these restrictions will actually mean in the end. Especially, and this is really the most crucial point, as the laws will shut down many other health services women need.

All they really care about is appeasing the far right wing of their base so they can maintain enough votes to hold office.

(1,090 posts)But I'm glad the courts are knocking this garbage down, my only worry is that once it's in the system they can appeal to the Supreme scum bags and have it found legal there. Can supreme court justices be removed? Or do they have to find criminal misconduct or something?

Yes, Supreme Court Justices can be impeached under articles I and II of the Constitution, but it's only happened once: Samuel Chase in 1805.

(2,605 posts)For the last four decades, the U.S. Supreme Court has consistently recognized a womans right under the U.S. Constitution to make her own reproductive health care decisions, and we are confident that the courts will continue to affirm that fundamental right as this legal battle continues.

(114,904 posts)a case with a 20 week ban? When could a case reach the SCOTUS? What case would it take? Lots of variables. The court is no differently constituted at this time as far as conservatives/liberals/swing vote than it was the last time Roe was upheld over 20 years ago, and there is no indication that Kennedy has markedly changed his opinion on Roe.

(34,648 posts)This is good news. As someone gave birth to a child with a genetic disorder who subsequently died, I feel that women need to have that option available. Had there been a test available for Zellwegers syndrome I would have chosen to spare my child from suffering. I had a terrible time with feeling guilty for not having an abortion when it was suggested to me. I was all right to life at the time feeling so superior to those who had ended pregnancies. I was so stupid. I didn't understand.
Thankfully there were women fighting for my rights that I didn't want.
