James outweighed Dooley by 80 pounds and obviously, being ex military, had some level of hand to hand combat training. Dooley was nearing 70 and would obviously had feared for his life being grabbed by a much younger, larger, and stronger man. If you use the Zimmerman jury instructions in his case, then you probably should have the same verdict.

What is not in dispute is that James took the first physical action and you have testimony from both the skateboarder and the daughter that Dooley had turned to leave. The couple put the gun in Dooley's hand prior to being grabbed by James, but the other two do not.

I used to accuse people of being ignorant of facts when they took a position I disagreed with too. It was convenience and simplistic, and allowed me to minimize the person rather than the position.
