Remember the 2 year-old who grabbed the concealed-carry permit holder's gun and fired in a Staples?

We have an update.

Wake County District Attorney says mom with gun at Staples did not violate law

RALEIGH — Wake County’s top prosecutor decided not to file charges against a Franklinton woman whose handgun misfired inside a Wake Forest Staples store late last week.

Wake Forest police on Friday announced that they expected to charge Danielle Hayes, 29, with failing to secure a firearm from a minor, a misdemeanor, after her 2-year-old son reached into her purse where she was carrying the gun and it went off at a Staples store Thursday evening.

District Attorney Colon Willoughby, however, said Hayes has a legal concealed-carry permit for the gun and was not in violation of the law, so no charges will be filed.

After consulting with the Wake County District Attorney’s Office, police decided not to charge Hayes at all, said town spokesman Bill Crabtree....

The kid got his hands on the pistol and fired it, period. It could hardly be more obvious that it was not properly secured (or safed). She should be charged.

Does a CCW permit allow a person to carry a loaded gun and if it has a safety, with the safety off? I honestly don't know these laws but I would be shocked if there aren't at least some stipulations. And if the woman violated any rules for CCW, shouldn't her permit be revoked?

There is no such stipulation about engaging the safety in the law here in Oregon (nor am I aware of any such in other states). I wouldn't mind seeing something added to the law in that regard. I mean...it should be utterly obvious that any carry pistol equipped with a safety should be carried with it engaged...but there never seems to be a shortage of idiots in the world. Such a provision could be simply worded to accommodate the rather wide range of safety types.

I have two pistols I use for carry purposes. the larger (and thus less-often carried: I'm a shrimp, and it's a bit bulky) is a Colt 1911 variant, and it's carried in "condition 1." That means loaded, a round chambered, and cocked...but with both the manual lever safety engaged and the passive grip safety in operation. It's the most common way of carrying a 1911. The other pistol is a compact 9mm that's carried almost the same way, but not cocked, as it has a "double action" trigger that uses the first long, rather stiff trigger pull to cock the hammer. That is in itself a safety, along with the regular lever safety. I don't think a toddler could manage to fire either one, even if they had time to mess with it. Not that I'm enough of an idiot to let either pistol fall into a toddler's hands...

I'd not mind seeing the requirements for issue include a more stringent demonstration of a person's competence, either. Of course, I feel the same way about driver's licenses...

You made the same claim in your other thread. Neither story says how the gun was fired.

"Hayes told police that when she noticed her son had his hands in her purse, she reached in to get hold of the gun and it fired one shot, hitting her in the right hand.

If your sidearm is out of your reach or not on your person it could be a danger to others....not to mention it won't be there to protect your life should you need it.

they have to be responsible for them. If my 2-year-old gained access to my car because I wasn't careful enough, damn straight I would be held responsible. I can imagine the hell that rain down upon me for that.
