Why Texas Banned Tesla Motors

Why Texas Banned Tesla Motors (Spoiler: Because we don’t have campaign finance reform)
Growing up, electric cars were among the narrative devices that science fiction films used to let you know you were in “the far future,” along with computers that fit in your pocket, video conference calls, and a black President. As a geek, I love new and creative technology, especially when that technology was stuff we dreamed about as kids.

Here’s the thing though: Even if I hit the lottery, I can’t buy a Tesla Motors electric car.

In fact, nobody can buy a Tesla car in Texas. The State of Texas has decided that you can’t buy a car from Tesla.

Why? Well, the Texas Automobile Dealers Association lobbied hard against letting Tesla sell cars in Texas, spending $276,750 on Texas political campaigns – about 75% to Republicans, (including $2000 to Rep. Dale, the incumbent in the seat I’m running for.)

You just have to buy it from them, and have it transported by a 3rd party vendor to you. If you're buying a Tesla you can afford the extra transportation cost. That doesn't mean I agree with this, consumers should be able to buy vehicles direct from the manufacturer. Frankly, this is hypocrisy from the "free market" "pro-business" republicans controlling this state.

Texas charges a 6.25% tax on all new vehicles initially registered in the state. I would pay the tax in another state and then mail a copy of the receipt to my state legislator explaining how they just lost over $6,000 in revenue to another state because they allowed the greedy dealers association to buy off the legislature.

Free-Market my ass. Not that I even believe in the "free-market" in the neoliberal economics sense, but the sheer hypocrisy of conservatives because they're always bleating about the need for it.

That "middle man" racket smacks of the distributor system for alcoholic beverage sales: You come up with a new product, you still go through us who had nothing to do with it. That's what the agency system is angling for, even if the legacy Incs couldn't care less.

I can see it now: State-Line Auto Sales, a cheap motel affixed to a big quonset hut fulla Teslas some where in New Mexico.

15. Dormant Interstate Commerce Clause, for one thing:

Sep 2013

"As Tesla pursues the direct-to-customer sales model, it has stated that it intends to become fully licensed as a seller of automobiles under the laws of each state. Seeing a threat, the association of automobile dealers in North Carolina has protested to the state’s legislature, who in turn is pushing a bill to require automobile manufacturers to use in-state dealers to sell their cars.

Of course, this reeks to high heaven. It clearly is designed to protect home-state interests. And, if passed, the law will likely be crushed under the weight of the Dormant Interstate Commerce Clause. The law should be invalidated at the trial court level. Other than minor legal wrangling, this matter should be of little consequence to Tesla." http://www.forbes.com/sites/toddganos/2013/05/15/north-carolinas-threat-to-tesla-likely-unconstitutional/

Also, there must be something in the Texas auto sellers actions that violates rules against combinations in restraint of trade.

Tesla Dealerships are not allowed. You can buy direct from Tesla on line or from another state. So yes I am sure you will see many Teslas throughout Texas, you just can't view one there or buy it there.

than there is for travel agents to exist. I want to be able to buy a Toyota directly from Toyota, or on Amazon. The phrase "let me check with my manager" needs to be consigned to history.
