Family goes to visit dying relative, stranger moves into their house and claims title

changes the locks and moves out their belongings. WTF? Why isn't this guy just arrested for breaking and entering?

A family from Springfield, Ohio, returned home from visiting a dying relative only to find a stranger had moved into their home and changed the locks.

Even worse for the family, who wish to remain anonymous, the intruder may have the law on his side.

The new "owner" of the house is Robert Carr. He pounced when the family went to see their ill relative. Not only did he change the locks, he also emptied the house and produced court documents to show he was the owner, reported The Blaze website.

If it happened to one guy, then it could happen to me. I must get outraged and be scared of yet another thing. Drones, people stealing my house, knockout games..... It's a wonder we're still able to leave our house sometimes.

This type of scam has been going on for quite some time in states that have similar laws. This particular individual currently holds 11 other quiet titles on what he deemed to be "abandoned" homes. This jerk in particular is a member of Sovereign Citizens movement.

so that helps to make them whole from a financial aspect. Never-the-less they shouldn't have to endure the burden in the first place. Perhaps tweaking state laws could stop this practice.

But yes, the law needs a bit of tweaking. It's a good law, but as with any good laws, if there is a dime sized hole in it, the bottom feeders will shove an elephant through it.

He claims the owners abandoned the properties, but wouldn't he have to prove this? And technically if there is a mortgage on the property doesn't the bank own it?

I just can't see how this guy would get very far and why he hasn't been arrested for breaking and entering, not to mention stealing the belongings of the owners.

Any real estate lawyers out there?

You can't just move into someone's residence, change the locks and claim it's yours, all of a sudden. Quiet title and adverse possession actions are governed by statutes and case law which establish time and action requirements, which have to be shown to have taken place. I don't understand why this family is being burdened by this crackpot's actions.

I was Class of '81, he's Class of '83. I have zero memory of him.

I think he believes this is legitimate. But if he forged the signature of the deedholder, it's not.

... Police say Robert Carr let himself inside while the family was out of town and made himself at home. When the family found Carr, he told them they had abandoned the house and that he was the new owner.

Carr said he had a "quiet title," which allowed him to claim the house as his own. Further, Carr felt the family had given up their rights to ownership.

Police saw the situation differently than Carr, and charged him with breaking and entering and theft.

A North Texas man convicted of theft and burglary after trying to claim squatters' rights on a house using an obscure state law was sentenced to 90 days in jail.

David Cooper faced up to life in prison for burglary of a habitation and one count of theft over $200,000.

Prosecutors said Cooper took possession of the house and all of its contents while the homeowners, a man and wife, were staying in an apartment in Houston, where she was undergoing cancer treatments.

Cooper said he was relying on a law allowing what's known as "adverse possession" that he studied at a law library. He filed a claim for $16 on a $400,000 Arlington home and moved in, but said he didn't know he was breaking the law.

PLANO -- Jeff Nunn and Melissa Nunn still can't quite understand what's happened to the home they worked so hard to build nine years ago.

Jeff and Melissa recently divorced and put their home in the Kings Ridge subdivision up for sale. Jeff moved out first. Melissa moved out in March, but they left many of their personal belongings behind.

Tuesday, neighbors called the Nunns to tell them strangers were in and out of the house. When Melissa arrived, she found men painting her home.

Those strangers were claiming Jeff and Melissa Nunn's home was theirs. They taped a piece of paper in the window announcing the home was abandoned and they were taking it over.

I was trying to figure out how this guy was finding these "abandoned" homes and I now know how. When a forclosure occurs the attorney handling the default is required to post a forclosure sale notice in the newspaper of local circulation. This is stated in the Deed of Trust or Mortgage that gets recorded in the County Courthouse. He then waits for the owners to leave the house and then claims that they have abandoned the property. He files theses briefs with the local courthouse to buy himself some time. Problem is the bank has a lien on the property and the house is the collateral. Say the owners have moved out because they do not want to be evicted after the forclosure is done, then this guy says the property is "abandoned' and he takes possession. This isn't going to work out for him because sooner or later the bank is going to win out and they will simply evict him. This guy is a scum bag plain and simple. he is preying on other peoples misfortunes.
