(56,177 posts)so obviously she was asking for it...this is clearly NOT a case of a football town deliberately pulling strings to protect its star quarterback, a young guy who figures since everybody worships him, he can do no wrong and do anything he freaking wants...I repeat...NONE of this obviously applies here.

Secondly, you know that I have discussed other topics prior to discussing this rape allegation; therefore you simply wanted to avoid explaining how it was that you found proof that the accuser was passed out prior to, or during sex.
Can you now answer my question regarding how you know what happened?

After all, any woman who drinks knows what effect the alcohol will have on her, and causing a woman to become inebriated *certainly* does not constitute rape if you have sex with her.

False accusations of rape are rare. It's not worth it. Heck, it's not worth it to report a rape, period, more often than not.
they found (the day after) when a rape kit was performed, a .04 BAC in her system, which extrapolates back to about a .10.
Apparently in FL .10 isn't drunk enough, absent other evidence, to be unable to provide consent.

(5,739 posts).1 is barely above the legal limit for driving (which anyone will tell you are kept at just barely above light impairment), if everyone who has consensual sex with someone at a .1 is a rapist then about half of Florida is a rapist.
Correction: Found a source that says it extrapolates to .1, that still isn't much.
A big problem is that she claimed to have six shots of alcohol, which put would even a larger person way over .1. Six shots would put the average person at around a .3, not a .1.

So yeah, nothing about what she says matches the evidence, insofar as her alcohol consumption goes.

I agree that there wasn't enough evidence, baring a state law which bars consent beyond a certain BAC, to charge him.
I have real problems with how the police handled the investigation, but that doesn't mean he should have been charged.

Yes alcohol does impact everyone differently. Frankly she could have been blackout drunk, but have a incredibly beneficent metabolic process for alcohol. That is possible, but possible isn't evidence.

(2,467 posts)When there are allegations of rape there are two equally important sides.. the right of women to file police reports and the right of the accused to be innocent until proven guilty. The equality of both sides is where the friction arises.. we cannot automatically assume guilt yet at the same time we can't assume that the allegations are unfounded.
It is a no win situation.
