Cop Acquitted in Beating Death of Homeless Man wants his Job Back

A day after being found not guilty of involuntary manslaughter and excessive force in the death of Kelly Thomas, Jay Cicinelli told the Orange County Register he wants to return to his former job and will take the legal steps necessary to try to make that happen.

“I was wrongfully terminated. How do you argue with a jury of 12 who all agree on the same thing?” he said. “They sat through the whole trial and heard all the facts.”

“I just have to see there this takes me,” he said. “It’s like starting over. … My whole life has been stopped.”

Michael Schwartz, Cicinelli’s attorney for the criminal trial, is also representing him in his fight to become a Fullerton police officer again.

“His identity of being a human being is totally wrapped up in being a police officer,” Schwartz said.

Once upon a time folks who gamed he system and got away with something like this had the good sense to keep a low profile, move a thousand miles away, maybe even get a new name or plastic surgery and start a new life...

Not content to just get away with murder; he now has to be a civil rights martyr...

And because it hasn't been said enough: A hearty "fuck you" to you right-wing piece of shit cop-worshipping Orange Country troglodyte cowards on the jury -- All you're doing is helping to build a case towards eliminating jury involvement in criminal cases altogether....

Well, that is just sad.

One's job--no matter how much one loves it or how noble a calling--should not be the sum total of one's existence.

I work, therefore, I am?

Maybe if this guy had a better concept of himself AS a human being, as a friend, neighbor, family member, child of God, whatever...he wouldn't have had to go through that trial and Kelly Thomas might still be alive.

no you murdering asshole, your life is still continuing on...unlike the dead man you helped kill in cold blood. I hope the alleged murderer never sees another day in law enforcement...last thing we need is for him to kill another homeless man or woman.

HEAVEN FORBID a cop try and HELP the homeless! Those that do, are shit upon tenfold by the disgraced Michael Schwartz's of the world.

RIP Kelly Thomas.

It didn't escape my notice that the cops sent what Schwartz called 'letters of support' (assuming he isn't bullshitting about them)

But on the whole, society and the legal system still subconsciously cling to the concept that some lives have more "worth" than others; which is why it's never any great tragedy when some homeless nobody from nowhere meets an unceremonious end....

A jury found him not guilty.

So, he's not guilty.

I'd blame the jury, if we only had a Meta forum.

I'm sure he'll either get his job back, or win a nice settlement from the city.

with the butt end of his Taser. Audio evidence was presented during the trial proving that he bragged to other cops about "smashing" Thomas' face "to hell."

Reason enough, right there.

I know that 'not guilty' doesn't mean 'innocent' and it also doesn't mean that he did his job correctly and, I would think, they aren't required to re-hire him if he broke with protocol (which is different from the actual law). I know here (my sil is a cop) they have a separate investigation in these kinds of cases and you can still be canned even if you are found not guilty of a charge.

Wrong, being found not guilty doesn't mean the jury said you didn't do the crime. It just means enough evidence wasn't presented to convict him "beyond a reasonable doubt."
