"I think he is likely to vote to strike down the individual mandate because it is a new exercise of Commerce Clause power," Fitzpatrick said. "And, in general, he believes that Congress already has too much Commerce Clause power. I think he thinks the mandate is beyond what Congress should be allowed to do." ....

I don't anyone should be confident which way this vote is going to turn out. Of course, they could Indict Clarence for his false AR-10 judicial income reports. Just saying.

so I have trouble seeing why it would be hard for conservative judges to uphold it.

I would love to see it eliminated as a stand alone clause but I think that is to much to hope for. Odds are the court will uphold the law as written.


I guess we shall see.
