Grand Jury votes not to indict homeowner for homicide.

As most here know I am vhemonately opposed to private ownership of guns. About the only single issue that raises the same venom in me is the abuse by and militarization of the police.

A Central Texas man who shot and killed a sheriff's deputy entering his home will not be charged with capital murder, attorneys said Thursday.

A local grand jury declined Wednesday to indict Henry Goedrich Magee for the Dec. 19 death of Burleson County Sgt. Adam Sowders, who was part of a group of investigators executing a search warrant for Magee's rural home.


So the story is this. The police showed up before 6AM to serve a "search warrant" with a no knock stipulation. The principle behind this is that by not giving the people three seconds to respond, they don't have time to react, or destroy the evidence. The evidence was several pot plants. Now, I don't know how you are expected to destroy several pot plants in three seconds, the normal delay on a knock and announce warrant, but the cops have their reasons right?

Personally, I've been waiting for this particular confluence of events. The stand your ground in your castle doctrine, and the militarization of the police serving search warrants. I can only imagine the rage of the police in that one of theirs was killed and the "bad guy" is going to get away with it.

All of this over a few pot plants. Wouldn't it have been smarter to wait until this guy was outside, perhaps mowing his lawn, checking his mail, and then swarm him and arrest him harmlessly in the front yard where he could see the cars with "Police" on the side? But no, the cops wanted to do the SWAT raid and charge down the door all of them shouting out of phase so the noise is uninteligable counter productive nonsense. Some screaming Police, some screaming Sheriff, some screaming get down, some screaming show me your hands, and still others shouting search warrant. It would be like standing in a room with five stero's blaring five different songs all at about the same volume. You couldn't tell what one of the songs were, much less all of them.

I guess we'll have to see what happens next. I'm betting that someone explains to the Grand Jury that they made a mistake, and they should rethink that decision. Either that or Henry Magee is liable to suffer a horribly tragic accident while in custody.
