Ex-Christie aides face legal showdown over N.J. traffic scandal

NEW YORK Tue Mar 11, 2014 5:08am EDT

(Reuters) - Former top aides to New Jersey Governor Chris Christie were due in court on Tuesday to explain why they have not turned over records and documents to investigators of a traffic scandal that has threatened the Republican governor's political future.

Bridget Kelly, Christie's former deputy chief of staff, and Bill Stepian, his former campaign manager, have so far not cooperated with subpoenas issued by state lawmakers looking into the September incident, when Christie aides apparently helped orchestrate traffic jams at the busy George Washington Bridge.

The closing of several access lanes to the bridge, ostensibly due to a traffic study that has never materialized, caused extensive, hours-long delays for four days in the town of Fort Lee, where the Democratic mayor had not endorsed Christie's re-election bid.

the response will delay the whole thing for a very long time. Who decides
if Kelly's claims of self-incrimination are merited? The judge? Then
appealed to a higher judge? Her emails must be very juicy. Can't she just
delete them? Would they get a forensic expert in to pull deleted files out.

though I doubt this will take long to resolve.

The Judge hearing the case will rule and if/when Kelly loses (based on about a century of precedent), it is unlikely the appellate court(s) will take the matter up ... because of that about a century of precedent.

The case law is clear that 5th Amendment only applies to documents in limited circumstances that are not applicable here

If the Hubble case does not apply directly, then Stepian and Kelly will have to produce some or most of the requested documents

The judge has requested additional briefing on the ability of the committee to grant immunity that is not due to completed until March 24. It will be a while before there is a ruling
