request made by Judge Smith for statement of DOJ as to authority for 'judicial review,' discussing on Lawrence show now, SAME THING I'll work on shortly for THOM HARTMANN, after his rant naming names (in particular, MY name!)

(131,129 posts)Judge on 5th Circuit Court of Appeals panel, just hearing oral argument in an 'Obamacare' appeal, who told counsel for government to explain, in writing, within 48 hours, 3 pages, single-spaced, President's (administration's) position on 'judicial review,' after judge heard POTUS' statement about role of Supremes in reviewing Affordable Care Act.

but I know he called you out on his show.

(131,129 posts)I hope to respond to his criticism, beyond his complaint that I referred to wiki, which, in this case, had it right, of course. Been out of town, so need a couple days to get back into things.

(75,480 posts)He called out your DU moniker, that's hardly calling out names. I've got to admit you were included in a list of not so cool DUers so maybe that's why you are miffed.

(131,129 posts)I'm angry that he was as wrong as he was, having thought he was well-respected for a reason.
I was #1 in his rant. I'm not 'miffed,' its more important than that.
Cleita
(75,480 posts)DUers, but it's my private list and I don't share it with anyone. However, have you tried to call into his show or show up on his website message board to address this and tell him directly? He has named DUers names in the past, but only in praise so I guess him being critical was a departure, so call him and talk to him directly.

(131,129 posts)I'm an attorney, and I plan to educate him, in a 'lawyerly' way, in writing.
Maybe you can give me links? E.mail address? Website?
Cleita
(75,480 posts)I will not aid and abet you on this. You are being childish. Since you are a lawyer, do your research.

(75,480 posts)If you write him, most likely someone else on his staff will read and reply. But it's up to you.

(20,453 posts)You've really got it wrong, Cleita; I'm seeking to educate Hartmann.
Cleita
(75,480 posts)When lawyers talk about "educating" it usually means sue. Perhaps you need to pull back your rhetoric. If you really want to educate Hartmann, call into his show. He will talk to you. He talks to all kinds of people who disagree with him. He is respectful. He is heard all over the country and overseas, so if you want to put him down and educate him, that's the way to do it.

(131,129 posts)so he can understand the way the legal system works, and use his knowledge usefully, in the future. This will require, imo, something like a legal brief; I will make it brief. Not conducive to a phone call.
Cleita
(75,480 posts)However on the air you usually are allowed a few minutes so it will be brief anyway. Try mail if that's what you really want. I doubt if you will convince him though. A polite confrontation voice to voice would be more effective IMHO. It's your choice.

(20,453 posts)To tell you the truth, it might be better to call him physically if you could on the show.
Even though you can argue he's wrong on some things (I've caught Thom being wrong), I think he'd be more reasonable to admit it.
Ya think he'd be reading this?

(131,129 posts)I may post what I write to him, after I've written it, but I plan to write him directly, and inform him about the law. I don't want to discuss or debate with him.
