George W. Bush (2007): For the judiciary, resisting this temptation is particularly important, because it’s the only branch that is unelected and whose officers serve for life. We have a democratic system of government in which decisions are made by the people's elected representatives. Nevertheless, there are constitutional constraints on those decisions, which are enforced by judges, who are not elected.

Each of these principles is valid but there's a tension between them. In practice, people emphasize democratic primacy when they agree with the challenged law, but are more favorable toward judicial review when they agree with the law's opponents.

How do you react when unelected judges strike down a government policy of indefinite detention without trial, or constraints on campaign-related spending? Liberals tend to cheer and boo, respectively, while conservatives tend to boo and cheer.
