For the FIRST TIME IN HISTORY, The House has voted to sue a sitting president.

Even more ironic, they are suing him for doing what EVERY PRESIDENT IN HISTORY HAS DONE!

So remind me again what the difference between this president and the 42 guys who held the office before him is?

And it pisses me off. I'm an old white dude too who voted for this President once in the primary, once for election to the Presidency and once more to re-elect him. I don't throw away votes either, I'm serious as death with my voting and always have been.

The GOP knows from their experience with Clinton that impeachment is not a popular gambit with voters.

They just wish to use any method possible to tarnish Obama. Except, well, the Constitutionally mandated ones.

This suit will backfire on them.

There is no doubt that any court will not take this seriously and not wish to set the precedent of allowing Congress to sue the President. That is, unless, it's the 5-4 majority on SCOTUS.

The administration will move to dismiss on the basis that the House and Boehner have no standing to bring such a lawsuit and that if they truly believe the president has acted in a lawless manner the remedy is spelled out quite clearly in Article I., Section 2., Clause 5 and Article II., Section 4. of the United States Constitution.

Does it have to go to the Senate or is it only the House that sues? What if any federal court would it have to go to? Or is it just a stunt?

It will probably be filed in the DC District court although it could be filed in another district court. Like most things in DC it is just a stunt.

Standing is a very well established concept in the law.

There can be no demonstration that the House, or Boehner, has suffered damages from Obama's order pushing back the date when certain corporations were required to provide healthcare coverage for their employees. The only people who have actual standing and can demonstrate said damages are employees of those corporations allowed to put off the implementation.

No judge who wishes to be taken seriously in the future is going to allow a case to proceed when the plaintiff has no standing.

It's so important that not a single Birther case proceeded due to the lack of standing.

I'd bet that the rightwing toadies turn on him declaring him an activist judge who thinks protecting Obama is more important than following the law.

The judge who gets this case will probably suffer public slanders no matter what he decides.

We don't sue and/or impeach Presidents for starting misbegotten wars in which thousands of American soldiers are killed and maimed, countless foreign civilians are killed or maimed, our prisoners are tortured (just like they were in the regime that we swore we had to replace partly because of it), and almost all of the reasons that we went to war proved to be totally WRONG!

Oh hells no!

Here, we sue and/or impeach Presidents for lying under oath about consensual adult sexual relationships in a matter that had absolutely nothing to do with official conduct or disagreements over how a health reform law mandate gets implemented.

Why?

Because, this is America and a lot of voters are letting Republicans run amok and trashing our government because they're a bunch of whiny sore losers.

Congressional lawsuits against presidents are rare. In 2008, a federal judge backed a suit by Democrats who then controlled the House and were trying to force the Bush administration to honor House subpoenas of senior White House officials. Though the House won the first round in court, that decision was under appeal when a settlement was reached and the lawsuit was dropped.

The lawsuit mentioned in tha ABC article was by the House Judiciary Committee and was limited in scope.

This is the ENTIRE HOUSE suing the president.
