(Reuters) - The Los Angeles Unified School District has come under fire from legal experts for asserting in court that a 14-year-old girl had consented to sex with her teacher and for introducing her sexual history in response to a lawsuit brought by the student.
A number of legal scholars and attorneys specializing in sex abuse cases said the argument that the girl bore some responsibility for the affair was at odds with the minimum age of consent - 18 - established in criminal law.
The legal principle that children are incapable of giving true consent to sex with adults is rooted in the widely accepted premise that they lack the requisite emotional and intellectual maturity.
For the nation's second-largest school district to argue otherwise was troubling, said John Manly, an attorney in an unrelated sex abuse lawsuit against L.A. Unified.

(146,317 posts)avoid their responsibility for this child. By arguing that a 14-year-old can consent to sex with an adult teacher, they're morally bankrupt and are doing nothing more than trying not to pay for their lack of responsibility for the safety of the students in their care.
14-year-olds cannot consent to sex with adults. Period. The teacher should be in prison and the school district should pay heavily for their lack of supervision.

(12,157 posts)And teachers shouldn't have sexual relationships with students no matter their age. Some as anyone in a position of authority. Just for that the teacher should be fired. For having sex with a 14 year old he needs to be prosecuted in court. If she was of age - just fired and no letter of recommendation.

IT. DOES. NOT. MATTER!
He was her teacher and knew exactly how old she was; there is no excuse or justification for his action.

(1,754 posts)Anyone making the argument that she consented and bore some responsibility should not be working with children! It's not clear to me from the article who made that claim - was it a school district official or the lawyer for the school district?
