Couple files lawsuit after Florida cancels drivers licenses over name changeORLANDO, Fla. Two Central Florida men whose drivers licenses were cancelled because they changed their names using their out-of-state marriage license, have filed a lawsuit against the state of Florida, seeking to have their legal marriage recognized by the state.
The Orlando Sentinel reports that Daniel Wall-DeSousa, 40, and Scott Wall-DeSousa, 37, filed the lawsuit in U.S. District Court, asking a judge to force the Florida Department of Highway Safety and Motor Vehicles to recognize their marriage.
The couple was married in New York City on Dec. 6, 2013, and a few days later changed their names through the Social Security Administration, each adding the last name of the other, according to the suit.
The couple eventually obtained new Florida drivers licenses showing their new last names, but the department abruptly cancelled them after they appeared in a local television news report.

(5,158 posts)Even if they don't recognize their marriage(which is wrong in and of itself) how can they cancel driver's licenses with the mens' new, LEGAL last names on them? Hope they win their lawsuit.

(34,137 posts)According to the Florida DMV, the name must match his Social Security card:
Florida law requires identification, proof of date of birth, proof of residential address, and proof of social security number (if issued, Chapter 322, Florida Statutes, requires the Department see proof of social security number for the issuance of driver license and identification cards) from all customers before a driver license or identification card can be issued.
The name assigned to the social security number must match the name that will appear on the Florida driver license or identification card. If you have recently changed your name, update your records with the Social Security Administration before you apply for your license or identification card.

Maybe Wall used an old SS card - but couldn't Florida come after him for that?
I am GLAD they are suing the state. My concern is that the state is claiming certain requirements and apparently is not abiding by their own rules. Originally, I thought that the state should abide by what the Social Security Administration had by accepting the name change for both the Wall-DeSousas. Let them use the name they have chosen! They are not attempting to defraud anyone and the name change MUST be legal since the Social Security Administration accepted it.
Who the fuck does the Florida DMV think it is to dictate a name use for honest citizens?

(34,137 posts)It's so screwed up and needs to be changed. And the damn people of Florida keep putting these Republican assholes back into office! Ever since Lawton Chiles died in office it's been horrendous here in Tallahassee and the Florida Democratic Party is completely incompetent - or in the pocket of big money.
I say this as a native Floridian who has voted Democratic since 1972.

(34,137 posts)No matter how much the government agencies interfere, at least we have some say in what they do. We don't have much say if any in how private companies run their operations so I really do not understand why they are considered better than our government!
What I do want is the people in charge to be elected in a transparent way and not gerrymander the voting districts solely to ensure they get re-elected. Which means, of course, getting the asshole Republicans out of office and someone in that will run honest elections.

(65,616 posts)What the fuck year is this again? I swear sometimes I get duped and believe it is 2014 and then BAM! Open DU and there it is in GD.
Some states are in overdrive, some in neutral and sadly states like Florida and Texas are stuck in reverse. They should be fired over it imo. Taking orders from the Boob Tube is tantamount to anything an insane cult could come up with. And that is what it is, insane laws to keep people unhappy and depressed. It's like this grudge against the pursuit of happiness.
