Branch would be responsible for enforcement.

Edited to add--the Congress would have to change the Cuban Adjustment Act. However, like Bill Clinton did, President Obama can modify the enforcement of the Act.

Either way...the rightwing will scream.

6. I saw no mention of political reform in Cuba or the release of political prisoners.

it is the start of a long process - no reason to give away all our bargaining chips. Besides - how does this hurt Cuba? Shouldn't people have the right to freely travel and live where they want?

3. So long as some vestiges of embargo/sanction remain the policy will probably remain in place.

However, once we get to a point of normalized relations with free travel and commerce, they'll probably have to prove a human rights case (discrimination based on political stance, orientation, e.g.) in order to stay if they come and ask for asylum. I wonder if we'll go for visitor visas or allow tourists to come in for a few weeks by filling out a disembarkation card, or what...?
