COURT: EX-VIRGINIA GOV. MCDONNELL WILL BE FREE DURING APPEAL.

Former Virginia Gov. Bob McDonnell will remain free while he appeals his corruption convictions, a federal court ruled Monday.

The 4th U.S. Circuit Court of Appeals in Richmond said McDonnell's appeal raises a substantial question of law or fact that "if decided in favor of the accused" is "important enough" to warrant reversal or a new trial.

The court also said McDonnell isn't a flight risk or a danger to others and that the appeal isn't just a delay tactic. It ordered that briefs in the case be filed by March 2 and set a May 12 hearing.

I was just about to say something like maybe he should be free since that might be SOP for this type of case, I was actually gonna say that and then I realized this is yet ANOTHER white, powerful male who will get every break imaginable.

How many black low level criminals are out on bail while they are awaiting on appeal?

For that matter how many white low level criminals, actually.

These are the standards courts are required to use, in making such decisions.

Does depend, of course, on use/availability of counsel who can take the appeal.

With 50 days off per year for good behavior, McDonnell won't even spend 2 months in jail per felony. What a miscarriage of justice.



How many criminals get 2 months of jail time per felony?

He'll be out in less than a year.

Appeals should consider the McDonnell case a waste of their time, and add a mandatory 10 year on top of McDonnell's sentence that must be served before the 50% good time ticks off, and it is to be serve consecutively along with his other charges.
