FORT MYERS, Fla. 8:44 AM Thursday Update: WINK spoke with Robert Harris Thursday morning. He said his client was treated and released from the hospital for his injuries. He says his client, John Marshall, is not in custody. He says all evidence points to self defense.
LCSO has not officially cleared Marshall of any wrongdoing. They have not commented further on the state of their investigation.
LCSO has not released the name of the victim.
Friends of the victim tells WINK News Thursday morning, they believe he was murdered.

Gopher tortoises are endangered and the loss of their holes endangers other species that rely on gopher holes for homes. It is ILLEGAL to disturb gopher tortoises or their holes.
I'm sorry the neighbor who fought with Marshall is dead - he should have notified Florida Wildlife officers about this problem and they would have made efforts to stop Marshall.
Thanks to the unknown deceased neighbor for trying to protect the tortoises!

(34,136 posts)When the county paved the road in front of our farm, I reported to them and to the wildlife guys that there were active gopher tortoise holes along our driveway. It slowed down the paving project since the wildlife people did a study to confirm what I had told them and the county engineers had to submit plans how they hoped to avoid disturb the gophers. Unfortunately, their plans didn't work and our gophers are long gone.
On the other hand, a development near us has a gopher tortoise conservation area and homeowners in those parts of the development have to observe very strict rules about landscaping, lighting, and agree to never disturb the gopher holes. Another section is devoted to conservation of the fox squirrels, with even more and different restrictions about hedges and trees. While I would never live in a development with a HOA, this is one whose provisions I cheer!
I hope the wildlife people down in Lee County are as serious as they are up here in Leon and that see this article and follow through!

(55,147 posts)BOKEELIA, FL - Authorities continue to investigate after a man drove his neighbor's body to his attorney's office - claiming to have shot the man in self-defense during a fight.
We spoke to neighbors who say tension between the two had been brewing for weeks; but they say the details don't add up.
It all started Wednesday around 4 p.m. Attorney Robert Harris said one of his clients arrived at his Fort Myers office on Virginia Avenue - claiming to have killed his neighbor - and the body was in the bed of his pickup truck.
"When the 911 operator advised me to start doing CPR, that's when I went, 'Oh my God! This is real,'" said Harris.
