So I posted here a few weeks ago about the crap job that I had and how they treat their employees. Today I got fired. I have never been fired in my life. They gave me $2000 in severance and said that should get me by. Thank God I got a call right after for an interview today, so fingers crossed. But the point is that I never had any training and they don't like the fact that I am gay. I am going to see a lawyer on Friday. I am the 99%, and I will rise up.

Actions that are hard for the employer to deny?
If so before you go see a lawyer get that together in a time line and make sure it's the thing that you present to them.

File for unemployment. Don't let them tell you that you can't, either.

(7,349 posts)Emails, letters, sworn statements. If you do have proof, they'll dangle a settlement in front of you. It might be that you haven't any real proof, but your suspicions are correct, and they'll fold and offer a settlement, rather than go to court.
$2000 should get you by? They really said that? The NERVE!

Any comments you make here are admissible in court as evidence against your case.

You are very lucky if what you claim is true...
I too had a similar thing occur to me years ago..
The Company I worked for invented a reason to dissolve my Position to avoid any legal action by me..

(979 posts)And i am getting unemployment thank god, but found out it will only be $444 a week. I think basically what happened is my direct boss didn't like me so invented ways to get me out.

(30,947 posts)I was laid off in 2010 and only received $330 a week. That is the maximum in Georgia where I live.
But my company was generous and gave me a severance package of 6 months pay.
Since I was of retirement age, I just decided to retire then as I was already collecting social security.

(979 posts)But what they didn't tell me was that I would also be the registrar and career services as well. It was just too much work for one person. The same thing happened to the last campus director, if I had known that I never would have started working there. They wanted to pay as few people as possible to run an entire school which is ridiculous.
I'd quit my job for that.

I cannot understand how it is legal, but it is.
PA. is a right to work state, so I lost my family health insurance because I got hurt.
I hope you get the job, I'm worried that all my injuries (rt knee, left shoulder now right shoulder) and my age, 55, is going to make it tough to find a job.
I have been drivng a big truck for 17 years with no tickets or accidents.
So hopefully that will be in my favor.
Everything is way up in the air, and I am a mess, psychologically.
I can only keep my head up and hope for the best.
And the same goes for you, hang tough, there are alot of folks worse off (I keep telling myself)
I will try and get a union job next, if I was a union driver they couldnt have fired me.

The uncertainty about the future is terrifying, but luckily the economy is going in an upward direction--as scary as this is, it would have been worse three years ago.
I'm sure your record will be a big help too--17 years with no accidents or tickets? Impressive!

(19,736 posts)IF you got hurt on the job, and you have proof, get an attorney. They will tell you if you have a case or not for free. This is against FEDERAL Labor Laws. There's a reason labor laws are federal because states are effing nutso. Seriously, check it out. This is not legal.

(4,886 posts)and, unfortunately, they CAN let you go (they cant call it firing).
The worst thing is the loss of insurance.
I have 2 boys 12 and 15, and I am terrified of them getting hurt right now.
Yes, we have the chip program and am filling out the paperwork now.
I will try like heck to get a union job, but I'm not that hopeful.
But the OP and I have to just keep trying, what else can we do?

I am getting workman's comp, but it is 2/3rds of what I made.
I am grateful for that, but the drop in $$ is hurting, but we are making do.
There are so many that are so much worse off, I truly wish I could help.
So I cannot complain, and try not to.
But to be thrown away like a broken tool is pretty disheartening.

(5,957 posts)I've gotten a severance package several times and I always had to sign an agreement that I wouldn't sue them before I got the check. If you signed such a release, forget about suing. If you didn't sign a release, I'm amazed they gave you anything.

(37,648 posts)I have a friend who actually walked out on his job at a critical time. He felt he was being harassed, hostile work environment, plus I now know he had an alcohol/pill problem. Needless to say, his career was ruined.....for a long while.
He got himself clean, continued continuing education in his field, maintained his friends & made new friends, signed on to www.linkedin.com. He also did relevant contract work when it came his way. I don't know how he made it financially.
But finally, after persevering for several years, he finally landed a great job with responsibility.
Your situation isn't as bad as his was. He was a drunk, pill popper, and walked out leaving his company in a pickle. I thought he'd never find another job, actually. But he finally did. My point being....if HE could do it, you can certainly get another GOOD job.
Keep in mind that if you try to sue your former employer, you may not be able to work in that industry again. Depends on the industry.
Please keep us posted. We care. This job thing is messing so many people up these days. The companies have become monsters in some instances.
