Cops on an 11-Year-Old Who Says She Was Raped: “Child’s Promiscuous Behavior Caused This”

Rape victims often feel like they're the ones being put on trial, but Joanna Walters of the Washington Post published a story late last week about a young victim of repeated gang rapes who actually was. When Danielle Hicks-Best was only 11 years old, she says a group of two or three young men took her to a house to sexually assault her. Her parents reported this to the police, and Hicks-Best was taken to the hospital, where the doctor discovered vaginal tears and scrapes. A few days later, when Hicks-Best was walking to the store, she says, the same group of young men grabbed her and did it again. Again, the rape kit showed evidence of assault.

Despite all this, no young men were arrested for the crime. Instead, Hicks-Best was arrested six weeks later and charged with filing a false police report. She had just turned 12 years old. Hicks-Best denied any guilt but apparently exhausted with fighting according to the Post, allowed an Alford plea, where the defendant accepts “that there was enough evidence for a conviction — in effect, consenting to the court’s finding of guilt,” Walters writes. Hicks-Best spent the next few years spiraling out of control, running away and acting out. Now, at age 18, she's trying to get her life back on track and is speaking out about what happened to her.

In 2009, the police and courts thought Hicks-Best was a false rape accuser who was lying to cover up for her naughty behavior. “All sex was consensual,”" one police officer wrote in an email discussing this case with his colleagues. “Parents are unable to accept the fact of this child’s promiscuous behavior caused this situation.”

If you're flinching at the phrase “child's promiscuous behavior,” you should be. A child, after all, cannot be promiscuous. To be promiscuous requires consent, and 11-year-olds cannot give meaningful consent. The young men accused in this case range from their late teens to 21 years of age, but apparently the idea that women—and girls—are the gatekeepers of sex is so ingrained that the police in this situation thought little of pinning the responsibility for this situation on a girl who is still young enough to play with Barbies.

Does not the rapist have a will of his own? I mean, if the rapist cannot handle his own actions because of an 11 year old, he needs to be locked up... twice. Being promiscuous is not a crime. Rape is.

It does not matter if it is consensual when it comes to an 11 year old victim and as the article pointed out some of the accused being 21 years of age. I am sorry for what occurred to this young woman and it is more than a black eye of those police officers and the justice system. I have worked in law enforcement and my step-father is a retired chief of police (in my experience the accused would have been arrested, charged, and more than likely sentenced to prison terms for their actions) so this type of atrocious complacency and out right refusal to enforce the law truly enrages me. This is a very sad and disgraceful excuse for police work and why reform is desperately needed.

The cops knew the rapists...I'll even go so far as to suggest several if not all, are or were informants for the police in the past!

Why that theory, based on the fact that the cops interrogated an 11 year old child and made a concerted effort to trap her in a lie...sounds like they were trying to protect someone...or the cops were completely incompetent...and in DC that isn't a far stretch!

I am not sure if they were informants, or if they were related to a cop, or in some other way connected to a cop or a prominent family, but I have no doubt that they were trying to protect someone.

When you have an eleven year old victim, the issue of consent just does not come into play.

Was one of the assailants a RELATIVE of an officer?? Was one of the assailants a police officer? This appears to be an extreme cover-up designed to insulate the assailants in an overtly illegal manner.

Police have to ask about consent when an adult reports a rape - consenting sexual activity is legal between adults, and thus they must establish that a crime (non-consensual sex) occurred.

But consent is not a legitimate investigative issue with an eleven year old victim. To establish that a crime occurred, one must merely establish that sexual activity occurred - which in this case was clearly established - and then find the adult participants.

but I know in my state (MO) this is beyond statutory. She was under 14 which, consent or not, is hardcore prison time for many years. Under 14 here does not allow consent and if the other person involved is 21 or over then consent must be at age 17.

(The "under 14" part was a big deal because of the Daisy Coleman case a couple of years ago.)

What's so incredible is the second incident! The cops didn't even warn the perps????

Either these laws are not being enforced or the cops involved are corrupt. Either way, someone needs to be held accountable (not the 11 year old).

How can you possibly charge an 11 year old with making false report, when under law the victim would have had to be at least 16 to be able to consent!!! Legally the child could not have consented!!

This is BEYOND shocking.

She wasn't of age to consent so how could any of it have been a false report? I don't care if she took off all of her clothes, propped herself spread-eagle on a card table and handed out tickets for admission. She was eleven years old which means she was not able to give consent.

It is also very unlikely that she did even apparently consent to anal and vaginal intercourse, and of course she could not legally consent to it.

This incident should not be allowed to drop. I believe Congress has the mandate to oversee DC - perhaps it is time for us to contact our representatives and make sure it is not. This is an outrage.

Well, we are told in the article that troubled kids are "brought in" to the penal system as a way of getting them additional services, but can that be done on a basis that seems entirely illegal to me??

This is one of the most haunting and deeply disturbing incidents I have ever encountered. I cannot stop thinking about it, and the implications.

It would be bad enough to get a "there isn't enough evidence to take to trial". But to file charges against her at 12. To push her into an Alford plea?

Sounds like a figurative third gang-rape occurred.

I agree that the cops were wrong, but then the entire system went bizzaro here.

Children's services, the prosecutors office and whatever judge was involved to convict her of filing a false report with two positive rape kits should all be removed.


And the males were all of true legal age of "late teens to 21"? With and 11 year old in any circumstances is rape.

The poor girl, I feel so deeply for her. I know the trauma she suffers. I hope she has a really good therapist. She needs it. Therapy helps a lot.

Thanks for the compassion. It was horrible. I went from a creative fun smart outgoing person into a ball of mess overnight. Much deep soul searching and therapy have helped tremendously.

That poor little girl, I can't even imagine what kind of challenges she is going to face as an adult for what has happened to her. People slip into horrible mental illness having gone through less than what happened to her. I hope she gets the help she needs and I hope she is a strong individual.

I am so mad I could and probably would punch one if I had the chance. However, the problem goes much higher up and is much wider spread. The person at the top of this steaming pile is a judge that should be defrocked or whatever they do when they knock the sob off the bench.

the local news has followed up to see how she is now, and it wasn't good. She's had depression and other difficulties since the rape.

so she certainly could be a teen mom by now.

But, that's not the point. 11 year olds have no ability to consent, even if they may be acting out. It was the responsibility of everyone else to avoid sexual contact with her-- that's a big part of adulthood. Older guys who see her as convenient for quick sex should pay big time.

That is, to act like an adult human being rather than as a predatory rapist.



I might have missed it in the article, but I didn't see the age of her attackers listed. Regardless, "young men" seems to imply that that they were old enough to be held responsible for the rape, if the police had acted like police instead of like victim-blaming child-rape-enablers.

the rape happened in 2009. She's local to DC, so it's been in the news here about how unfairly she was treated back then.

Each time I prepare a reply and upon due consideration realize that reply would get a vote of seven zip on the alert. Then I leave it and wait. I re-read the thread, and my anger surges, and again I have to walk away before I give reason for a hide.

The girl was eleven, the boys late teens to twenty-one! As far as I know, that's STATUTORY RAPE and it should be prosecuted as such, and it doesn't matter if the girl was promiscuous.

She didn't scream out loud enough when she was raped, hence made it consensual, and a criminal for filing a police report for rape.

I didn't realize that the age of consent was 11 years in that state.
