A Cleveland judge has found probable cause that a crime was committed by police officer Timothy Loehmann in the shooting death of 12-year-old Tamir Rice. The sixth grader was killed last November as he played with a toy gun in a local park. The ruling is advisory in nature and does not mandate that a prosecutor pursue criminal charges or effect an arrest.
Thursdays decision stems from an obscure Ohio law that allows citizens to submit their own criminal evidence before a judge. According to the Cleveland Plain Dealer, a group of local activists and local clergy petitioned the court to find probable cause against Loehmann and his partner Frank Garmback on aggravated murder, murder, involuntary manslaughter, reckless homicide, negligent homicide and dereliction of duty charges.
The judge found probable cause exists to charge Loehmann with murder, involuntary manslaughter, reckless homicide, and/or negligent homicide.
The judge did not find probable cause that either officer should be charged with aggravated murder, said the Plain Dealer. Judge Adrine also determined that there was not probable cause to charge Garmback with murder.
However, the judge said he believes probable cause exists to charge Garmback with reckless homicide, negligent homicide and/or dereliction of duty.
