Virginia Just Banned Using ‘Cuss Words’ In Public

If you are in the City of Arlington, you could be faced with a $250 if you say words that county officials have defined as “profanity”.

The Arlington County Board recently approved the bizarre measure which increases penalties for both public intoxication as well as what they are calling “blue language” from $100 to $250.

This code change was adopted during last Saturday’s board meeting, not in 1852. It came at the request of the Arlington Police Department itself, which reported making 664 arrests for public inebriation as well as “potty language” in 2014 alone!...

The city officials did note, however, that the new revised regulation replaced the word “drunkenness” with “intoxication” so they can more easily crack down on anyone if they appear “intoxicated” even if they do not have any alcohol in their system.


Hmmm... you don't suppose any particular group of people might be more likely to appear "intoxicated" even if they do not have any alcohol in their system, do you?

it's barely a suburb, more of an extension of DC on the Virginia side.

Given that it's an effectively urban environment, the possibility of actually stopping people from using curse words is zero and they have to know it.

A quick check of their FY2016 budget shows expenses of $1.5 billion and revenues of $1.1 billion. A $400 million annual funding gap is plenty of incentive to seek any excuse to generate new revenues.

There has been a law against the use of profanity in public on the books in Arlington for a long long long time. The penalty was $100. It was increased to $250 because that is the fine provided for in a state law against public use of profanity. But the law is almost never invoked, which is why your claim that this is about revenue generation is inaccurate. In 2014, Arlinton issud four citations for public profanity, two in situations where people were cursing in front of children and kept it up after the cops tried to get them to stop. Another one was for someone who also was charged with public drunkeness.

As for the change from "drunkeness" to "intoxication", that was done to make it clear that it covered being under the influence of illegal drugs as well as alcohol.


Notwithstanding all of the above, chances are that the law against public cursing is unconstitutional as written.

Isn't this a matter of where you draw the line of offensiveness. Some people, like those on the Arlington County Board, draw it so every shit, fuck and a-hole might get you fined. Others, possibly even some here, draw the line a anatomical slurs.

Seems like DU and Arlington might have some things in common when it comes to defining "offensive" and the desire to manage the words used in public.

Taber bylaw bans public swearing, spitting and yelling in Alberta town

Watch your language in the small Alberta town of Taber, where the council has passed a bylaw that outlaws swearing in public.

The first offence would cost $150, while a second offence could set you back $250 — and that goes for yelling or screaming in public as well.

Taber Mayor Henk De Vlieger​ said council is going to give the bylaw a six-month trial before reviewing it. The mayor said the bylaw will only be enforced in extreme circumstances.

"It's just like every other tool, you can use it and abuse it," he said. "A hammer I can use to pound a nail, which it is intended for, or it can kick in your brains."
