One of the officials said that Roof, who is white, told investigators that he wanted to start a race war.

(15,429 posts)Roof had a felony beef that had yet to be adjudicated and thus selling him a firearm is a federal offense. Not only will they lose their license, they will possibly do prison time.

(7,635 posts)however I am wondering if it would show in background check if he had not been convicted yet and it was still beong adjuticated ?

(36,437 posts)One doesn't have to surrender currently owned firearms if under felony indictment, but you can't buy new ones.

So it is a grey area, if he was arrested but not indicted or if he was charged with a crime punishable by less then a year, he would not show up on the NICS check. I am fairly certain the gun store followed the rules, very, very few gun stores are going to risk their FFL, potential prison time and possible civil suit for a couple of hundred dollars they make on the sale of a gun.

As an aside, as usual, many of the initial "facts" from the media are wrong. Personally it'll be at a least a week before I start believing the details that are being reported.

(5,586 posts)The store will have retained their records. If he passed the background test, then that will have been indicated. If he didn't and they sold him the gun anyway, then they're in big trouble.
