Mom Violently Attacked by a Cop while Picking Daughter Up from School, for Parking on the Grass

Cutler Bay, FL — Rita Guzman, 25, was arrested last week after being violently pulled from her vehicle by a power-tripping police officer as she attempted to pick her daughter up from school.

Guzman was not wanted for murder, or theft, or even a subject of the state’s immoral war on drugs. She hadn’t caused harm to anyone or anything. Instead, Guzman had fallen victim to the latest revenue collection scheme conducted by Miami-Dade cops at Dr. Edward L. Wingham Elementary School in Cutler Bay.

When school lets out and parents arrive to pick up their children, police prey on their unsuspecting hosts who attempt to park on the grass. That’s right. The video that you will see below of an innocent woman being fiercely yanked from her vehicle by a public servant is for her choice of parking spots.

Local News 10 spoke to a parent, whose child attends the school. They said police have been handing out citations to parents every day, although there is limited parking availability for parents.

Mom busted for failing to obey police order while waiting for daughter at school
BY CHARLES RABIN
OCTOBER 9, 2015
... The officer, whose name is listed only as C. Brown on the report, said when Guzman refused to move her car, he demanded her driver’s license and registration. When she repeatedly refused, he told her she was under arrest. “The defendant began to rotate her body away from my attempts to handcuff her. I issued several loud verbal commands to place her right hand behind her back. I was finally able to handcuff the defendant,” Brown wrote in the report ...

He must have been oblivious to the fact (or, more likely, didn't care) that he was dealing with parents who were picking up their children at an area with inadequate parking accommodations.

From the OP's link:

“I was on the phone, distracted, and the officer asked me to move. I was fine with that, but I didn’t know where. Then it escalated, and he was really aggressive with me,” Guzman said.

According to police, Guzman asked the officer, “Why are you being nasty?” and refused to hand him her driver’s license. For failing to instantly and conscientiously obey his commands, the Miami-Dade officer used the only means he apparently knew to rectify the situation — violence.

News stories indicate there are signs about parking and that police are there every day issuing citations to people who ignore them. I have no idea whether the officer's report is accurate, but it apparently says she didn't move when requested to move, that she wouldn't provide her driver's license (which would have been a normal step in citing her), and that she then refused to exit the vehicle. That sounds like four strikes against her: ignoring the signage, failure to move her vehicle when requested, refusal to allow herself to be ticketed, and resisting arrest

Pulled all the information he needed to write her a citation for her parking violation and then continued with his day.
Her refusal to offer information or co-operate in the issuing of her own ticket is surely it's own citation, but ALSO not one that should have required hancuffs.
This is about her not 'respecting his Authoritai', as it were, and the officer, in my opinion, over-reacted.

People pull all sorts of stunts

A friend of mine sat locked up in jail over the weekend once for a traffic ticket. When we finally tracked him down and sorted everything out, the story was this: some jerk, driving a car that did not resemble the one my friend actually owned, was stopped by the police for a traffic violation, claimed not to have his DL, identified himself as my friend and gave my friend's address, got the ticket and drove away; the ticket was never paid; and an arrest warrant was issued. They dropped the charges when nothing tied him to the car

People lie; people switch plates; people steal cars; people borrow cars from friends. So it's standard procedure to ask for the DL of the person behind the wheel

You've got yet another fun afternoon dealing with all the folk like me who've ignored the no-parking signs. You ask me to move. I don't. You decide to cite and ask for my DL. I won't give it to you. You ask me to step out of the car. I refuse. Most people cooperate in such circumstances; and some of those who don't can be nightmares. So far I've not only ignored the signs: I've ignored instructions to move, to produce my license, and to exit the vehicle. Am I just clueless or am I some crazy buying time until you let your guard down?

I don't think she can win a case on this. She can probably get the charges bargained down to her paying the citation she would have gotten and court costs. And the fellow who arrested her will probably get a fingerwag about being pleasant to parents picking up schoolkids

the flow of those cars is crucial to the safety of the children. A person who just decides to drive up on to the grass and then stay on their phone when the police confront them is not showing a lot of concern for the safety of children.

How does she get out of that spot? Likely she has to back up -- and children are like 40" tall so she could back over one of them.

Not saying the cop needed to be that physical but this woman is showing very little concern for anything other than herself and her phone.

The car was parked when this took place. There is nothing wrong at all in using the phone while the car is parked, and there is no reason to assume at she had to endanger anyone to leave. It's possible she chose that particular place to park because it posed less risk to the children than any other available spot.

Now instead of her having to pay for her bad actions, she is probably going to get a huge payout from the taxpayers. Cops today rely far too much on brute force and intimidation, and that is is bad for everyone all around. Citizens get abused/killed, police lose respect, and lawsuits get filed.

It would have made far more sense for him to inform her of the ticket, wrote it up, and then stayed there to ensure the safety of children.

Apparently she just kept talking on the phone and ignoring the cop after he told her to get her car off the grass. That escalated things. The cop asked for ID to write her a ticket, she refused to provide it, and when he tried to pull her out of the car, she resisted that as well.

I'm 100% against police brutality and cops stepping over the line, but there are also plenty of plain old self-centered assholes out there who are going to play the victim if they can.

It's not like he hit her or tased her. She refused to move, get off the phone or provide ID. What was he supposed to do? Say, oh never mind?

And it seems she was very aware of the ticketing policy.

Maybe I'm biased because I live near a school and, every once in a while, make the mistake of forgetting not to drive past the place at 3:30pm. The parents think picking up their special snowflake means traffic and parking rules don't apply to them.

Not to mention, I spent another 2 hours of my time waiting for a tow truck last night to remove people parked in my parking lot. Second time in as many weeks. Who parks on someone's property with a big giant fucking tow sign in this neighborhood? Ignorant fuckheads, that's who. I almost felt bad when the truck dragged the car out - tires screeching and all. Almost.

1/2 "dirt," 1/4 water, and 1/4 AIR, and a few percent of organic matter. The air spaces allow the water to run in (instead of off the top) and provide growing space and oxygen for the roots. The weight of vehicles compacts soil into something close to 100% dirt, where grass can't live.

Yes, she was doing damage by driving on the lawn.
