Question to FBI Dir.: "If I buy a gun on the internet is it delivered to my home?"



Its not a simple answer, but I would have thought he could answer it.

FBI Director Comey - December 9, 2015 to the Senate Judiciary Committee when reporting on the San Bernardino shooting.


Let's see if I'm right.

States may have stricter requirements, but from the Federal point of view....

If you're buying from a gun dealer with a FFL, no it can't be shipped to buyer directly (whether in-state or out-of-state for long guns, not handguns). It has to be face-to-face and a form 4473/NICS is required.

If you're buying from a private seller who is another sate, it can't be shipped directly. It has to go to a FFL in your state and a form 4473/NICS is required.

If you're buying from a private seller who is in the same state, then it can be shipped directly via USPS or UPS.

Do I have that right?

USPS will only ship long guns, handguns must go through other shippers. IIRC FedEx and UPS will only deliver to FFLs even if the shipping is intrastate.

it did not say in what country. The article did say that guns were bought surreptitiously and sent to the buyer direct.

While it is technically legal to ship a gun from a person, to another person that lives in the same state as you (depending on state transfer laws)

USPS, UPS, etc will not do it.

Intrastate transfers between two individuals tend to be "face to face" because their is no way to ship a gun from a person, to a "non FFL, or gunsmith"

This is one of the "great loopholes" that they crow endlessly about, the gun show loophole only exists in there minds, and the moaning a endless whining is about "face to face" transfers' between state residents. Anyone who continues to argue about it is only exposing how little they know..

It is sort of like the people you see driving down the road, in the rain with their flashers on. All they are doing is advertising their ignorance.
