(62,444 posts)Every criminal defendant is entitled to an attorney. It's the only professional service to which you have a Constitutional right.
If a defendant is denied bail at a preliminary hearing, then it is automatic to seek reconsideration. Not to do so would be malpractice.

(82,849 posts)Beckermann is a Magistrate Judge, a judge of lower standing in the federal system. The first "appeal" if you want to think of it that way, is for the losing party to ask a full judge to review the magistrate's ruling. Mosman's title is U.S. District Court Judge, and he's of higher standing than the Magistrate Judge.
Usually the District Judge's ruling follows the Magistrate's ruling, but sometimes the District Judge will overrule for abuse of discretion or on the basis of a different law or interpretation.
