"Today's decision is the pinnacle of our Eighth Amendment death-is-different jurisprudence. Not only does it, like all of that jurisprudence, find no support in the text or history of the Eighth Amendment; it does not even have support in current social attitudes regarding the conditions that render an otherwise just death penalty inappropriate. Seldom has an opinion of this Court rested so obviously upon nothing but the personal views of its members.

Dissent from the 6 - 3 majority in Atkins v. Virginia (2002) which found the execution of persons with intellectual diasbilities was cruel and unusual..

My bet is that the advice and consent of the Senate will delay any appointment beyond the next presidential election.

What's more, we can assume the seat will remain vacant for the foreseeable future if a Democratic candidate is elected.

much as they'd like to, that's a bit too much for them to get away with. they can certainly reject the first couple of nominees until they get someone "acceptable", but they can't just leave it vacant.

They admit they plan to do it with the the Executive branch, and it looks like they may just try the same with the judicial branch. Our goal is to shrink government to the size where we can drown it in a bathtub.

they still resent that a democratic senate said "no" to bork. great deference should be given to the president's choice of nominees, they insisted. but when it's democratic president, they're all about preventing a liberal from joining the court, and by "liberal" they pretty much mean "any nominee of a democratic president".

I saw it and I thought ...Is this true! It can't be! My friend George who died of HIV related illness several years ago had wanted to kill him more than anything before he died. Until the day he died, he regretted being too weak and scared to do it..... He's gone George. He can hurt us no more....
