Now that Scalia is dead. What will Clarence Thomas do?

We all know how tight they were, maybe with this whole Scalia being dead thing, he'll save us all some annoyance and pain and retire. It's not like he ever has anything to say anyway.

His legacy is ironically judicial activism, cases like citizens united and mcutcheon, hobby lobby, gore v bush, Clinton v Jones and the boy scout case all demonstrate a commitment to partisanship over the law.

I keep laughing because I had a really long surgery and my heart stopped beating. And they would get the paddles and it would start again. I did that 5 times my doc told me, he said one more time and he would have gone for the stake.

Woke up in my bed with a RN pulling a needle out of my iv. From then on it was a very enjoyable experience. I had 2 bags of antibiotics going and misc other crap going for 5 days. I did not catch a cold or sniffle or anything for about 5 years after that.

The funny thing about mine is I never got bill from the hospital or the surgeon. I went to see the surgeon about 5 years later when one of the screws was coming out of my foot. I was sitting in his room and he was looking at the X-ray they just took and say "this leg looks awful familiar. Are you pulling anymore of those stunts or do I need a stake". They were ll good people and took me with no insurance and did about a 8 hour leg surgery on me. I really believe anyone else would have cut it off. After all the mangling of the leg, I only have loss of feeling at the very tip of the big toe. Good folks.

However, where he is in real trouble is at the post-argument conference at which justices vote and writing assignments are given. After the Chief Justice opens the discussion, the justices go around in seniority order to give their opinions. So now Thomas has to speak after only Roberts and Kennedy. Does he indeed have his own opinions and will he voice them? Will he start following Roberts? He certainly won't follow Kennedy--that's clear. Will he pass and wait for Alito to speak? Roberts is slightly less reactionary than Thomas, so this may actually have a bigger impact than just replacing Scalia. It could potentially impact Thomas' reliably reactionary vote in a better direction?

I don't think he will retire as long as Ginny is well ensconced (and thus distracted/busy) in the busy rw media/lobbying/politicking crowd in DC.

Though he does often appear to be colossally bored by the whole thing, so *shrug*

And the other follows shortly afterwards. I really can't imagine him enjoying being on a liberal court. I think he gets his jollies being on the "winning" side of atrocious 5-4 votes. If Obama gets a nominee through and the Dems win the white house again, he will soon retire.
