Almost immediately after the first public confirmation that Justice Antonin Scalia had died, Senate Majority Leader Mitch McConnell signaled that the GOP-controlled Senate would block President Obama from nominating Scalia's successor.
"The American people? should have a voice in the selection of their next Supreme Court Justice," McConnell said in a statement. "Therefore, this vacancy should not be filled until we have a new President.
McConnell's statement came as a chorus of conservatives called for the confirmation process to be delayed until the next President takes office in January 2017.
Minority Leader Harry Reid countered in his own statement Saturday that said the "Senate has a responsibility to fill vacancies as soon as possible" ...

(88 posts)But any nomination must be confirmed by the Senate.
He will be blocked, no matter whose name he throws in there...whether it be the most learned legal scholar of the century (whoever that may be) or the dumbest political hack there is. (Harriet Mier comes to mind.)
We will not see a replacement for Scalia during this POTUS' term.
Period.
Reid can posture and pontificate all he wants, and he should, but it will not do any good.
The next POTUS (he or she, (D) or (R), will do the nominating.)

(31,893 posts)Indeed. Which is exactly what the American people have now, having elected Obama for a second 4-year term in 2012. McConnell can go cheney himself.

(15,805 posts)the Constitution makes no provision to give the American people? a voice in choosing the next Supreme Court Justice.
These Constitution loving Republicans are frantically trying to rewrite Article Two in a last ditch attempt to convince the public that the President must shirk his Constitutional duties in order to give the GOP dibs on getting the next Supreme Court pick.
Even if he wanted to -- and he surely does not! -- he can't because it's his sworn duty to appoint new judges... as in "he SHALL nominate". There's no wishy washy other option to avoid carrying out his Constitutional obligation.
