Warren nailed this point. We elected Obama for a four year term and the Senate for six. Both should do their jobs now. Going over a year with a court with an even number of justices would be shameful.

Scalia was nominated in a mid-term election year and Kennedy at the end of Reagan's administration. Why the delay now? Reagan certainly didn't have any issues with nominating as he was leaving the office.
