"The U.S. Constitution, Article 2, Section 2, Clause 2 says presidents nominate justices to the Supreme Court. It says the president SHALL and does not say MAY. This means it is not an option.

The US Constitution says the Senate votes to confirm or not confirm the president's nominee (advice and consent).

President Obama should do his job and nominate. He should not ignore the Constitution. It is noteworthy that many of his political opponents say he routinely does violate the Constitution with the exercise of his executive orders.

The Senate should do its job: confirm or not confirm."
