Marie Hatch is my sister's former mother-in-law, and she is 97 years old. She has lived in the same house in Burlingame for 66 years. As she has no email or tech savvy at 97 years of age, and as her life-long friend, I am starting this fund for her. On Feb. 11, she was served with a 60-day notice to vacate the house or be tossed out by sheriffs deputies. Marie is fighting her second battle with cancer and has no more in her savings account.
The man who is evicting her inherited the house by default from his estranged wife who was murdered. His wife, her mother AND her grandmother all promised Marie that she could live out her natural life in the house. The current owner knows about this, but because there is no written contract, he is choosing to ignore the vow. That's his right. He wants his two sons to have the money now. There are two homes on two lots that should sell for approximately $3,000,000. The plan is to demolish them and build a large mixed-use building on the property.
We only want Marie to be able to stay at home for longer than two months, as she is ill with cancer and in no shape to move. Nor can she afford to move. But if the eviction proceeds, Marie will need money for obvious reasons.
You can read about Marie's situation on the following link:

Marie worked very hard her entire life and should be able to stay in what has been her home for 66 years. She can't do it without your help.
Thank you so much.

(58,785 posts)Marie in it until she dies. The problem is her co-renter, who also needs a home. In any case, obviously the cost until Marie no longer needs it should be eaten by the inheritors, OR by the investor they sell to. There are a variety of ways this could be handled kindly without hurting anybody. No excuses.

(41,145 posts)particularly the investor. The 'want to' is missing, and that's disgraceful. Grrr...

(17 posts)I donated a small amount to her. It makes me ill that they would put a 97 year old with cancer on the street.

(41,145 posts)with their commission will do very well on $3 Million for the two properties, esp. while the bloated market there and elsewhere holds, before possible decline soon.
The involvement of friend Lisa who started the eviction fund, and the attention and financial help Marie is receiving now is reassuring. A move for her after 66 years in the cottage will be very difficult, but the owners seem intent on selling. A caring transition to a stable new home for Marie Hatch will hopefully take place in a few months.
What a lovely woman, so serene looking and one who has worked very hard all her life.

Had a building in my old neighborhood, where the property was valuable, but not the building. Also the building was being rented to a disabled lady. The owner wanted to tare the building down (it needed it), and put a new more valuable building there. He helped her move to an apartment about a block away, paid her rent the whole time she was there, demolished the old place, and then moved her back into the new one. She lived there for another 5 or so years until she passed away. The owner made a small fortune on the additional rental and retail space. It was a win-win.

(41,145 posts)found for the disabled woman can absolutely happen if the 'want to' is there.
Apparently not the case, so far at least for these owners or their RE people who could try to work out something.
It will be very difficult to relocate after 66 years in the cottage home, and given her age and health but Marie has her friend Lisa who set up the fund involved and likely other support now so that's really good.
This fund was set to raise 10K and is already over 5K since today. I think people might donate even more and the amount maybe changed. It's noted that Marie Hatch is all out of savings due to medical needs. This lady deserves so much.

(849 posts)What is it with the rash of elderly people getting shafted by lawyers, courts or the government or kicked out of homes.
A few weeks ago the 90 yr old and his wife https://www.gofundme.com/hpnqrkp8
and now this poor sweetheart.
Disgusting and heartless !
branford
(4,462 posts)but I've yet to see anything remotely illegal on behalf of anyone. As I indicated in the earlier thread, the particular facts concerning the trust in this case might also make a generous settlement near impossible.
Unfortunately, unless the fundraising provides sufficient resources to purchase the property at market value ($1.5 million?), it probably will not do much good other than help afford a better lawyer who might be able to delay the eviction a few months more.

(41,145 posts)also take advantage of elders- prescribing unnecessary off label medications like drugs to sedate them and for profit, stealing jewelry and personal possessions, and abuse sorry to say. So wrong and sad.

(4,462 posts)However, under the CA Statute of Frauds, any such grant or gift of a life estate needed to writing to be enforceable. It's too late for that now.

(4,462 posts)no less satisfy the Statute of Frauds.
Even if a memorialization was not required, a lot more evidence would be needed to establish such a gift without any consideration so long ago.
