https://www.yahoo.com/news/dea-reconsider-marijuanas-federal-status-161148911.html?nhp=1The US Drug Enforcement Agency (DEA) announced in a letter to lawmakers this week that it intends to make a decision on the federal status of marijuana within the first half of 2016.
The drug currently sits on the Controlled Substances Act as a Schedule I item, meaning it has no currently accepted medical use and a high potential for abuse, and can trigger potentially severe psychological or physical dependence.
There have been growing calls for a reconsideration of marijuanas federal status, as four states and the District of Columbia have already legalized its recreational use, and the Department of Justice ruled that prosecutors should not enforce federal laws except under exceptional circumstances.
Reclassifying cannabis will make scientific research easier and will send a strong signal that the U.S. government is finally ready to acknowledge that marijuana has medical value, said Tom Angell of Marijuana Majority, an advocacy group, reported The Washington Times.

(62,444 posts)Administrative agencies are delegated authority by statute, and every one of them has a corresponding oversight committee in Congress, the members of which are elected.
If the Congress passes a statute that says, "We're going to let the EPA decide how much lead can be in your water", then the EPA has the authority to decide how much lead can be in your water.
In the course of making those kinds of delegation of authority, there is a raft of rules (the Administrative Procedure Act) which determines the processes by which those agencies make rules.

(12,413 posts)I stand corrected yet still wonder if Obama has had the authority to remove Pot from the CSA or not.

I don't think they'll budge on it.

(54 posts)Cannabis being classified as a schedule 1 drug is completely and totally absurd. It's literally impossible to defend this classification in any sort of rational or logical way. Of course, cannabis prohibition was never about reason, science or logic from the start. In essence it's been a culture war. The powers in charge didn't like the culture cannabis use represents and the culture of those who frequently use it.
Nixon(may he eternally burn in hell) ignored the findings of his own shafer commision when they didn't align with his irrational hatred of hippies and the counter culture movement. From that moment on cannabis has been stuck as a schedule 1 drug.
Now in the present day, it's less of a culture issue and more of a financial issue. Our government only does things to benefit themselves and their campaign donors. The LE/Drug enforcement/private prison/big pharma/big tobacco/big alcohol industries probably don't want cannabis to be legalized. It would either cost them jobs or compete with their products.
