It reads as follows:
Any citizen of the United States, wherever he may be, who, without authority of the United States, directly or indirectly commences or carries on any correspondence or intercourse with any foreign government or any officer or agent thereof, with intent to influence the measures or conduct of any foreign government or of any officer or agent thereof, in relation to any disputes or controversies with the United States, or to defeat the measures of the United States, shall be fined under this title or imprisoned not more than three years, or both.
This section shall not abridge the right of a citizen to apply himself, or his agent, to any foreign government, or the agents thereof, for redress of any injury which he may have sustained from such government or any of its agents or subjects.
1 Stat. 613, January 30, 1799, codified at 18 U.S.C. § 953 (2004).
So what was Americas least experienced major party presidential nominee doing when he asked Russia to sic its hackers on the emails of a high-ranking American government official? Hmmm.

For Harvard law professor Laurence Tribe, not only do Donald Trump's "jokes" about Russia amount to "inviting an adversary to wage cyberwar against the U.S.," but they also "appear to violate the Logan Act and might even constitute treason, he tweeted Thursday.

The latest tweet from the liberal legal giant whose name has been floated as a Supreme Court pick comes after Trump and his campaign brushed aside the backlash over his remark. The Republican nominee himself telling Fox News that he was "being sarcastic."
Imagine what our 1st president would've said about a candidate inviting a foreign power to intrude into a US election for the 45th president, Tribe previously tweeted Wednesday, adding that he must have been hallucinating at hearing Trumps calls for Russian hackers to infiltrate Democratic presidential nominee Hillary Clintons emails.

(3,424 posts)Oct 1962 type situation. Can anyone imagine him, with his temperament at a time like that?
Trump's NATO comments last week set my hair on fire. Guess the media is looking forward to the war coverage? And what's up with the weird Bromance between Trump and Putin. He says John McCain isn't a war hero but calls Putin "a great leader"? If he loves Russia so much he should go run for office there.

Two things are operative here:
1) Trump is so privileged after escaping 4 or 6 bankruptcies that he thinks he can get away with anything.
2) Trump is so door-knob stupid he is running a completely amateur campaign organization and can't see how amateurish it is.

(32,023 posts)No one. That is because centuries ago the DOJ determined the Logan Act was unconstitutional and throughout the decades every DOJ has agreed with that. Everytime someone talks with some foreign leader or group someone in the other party claims it is a Logan Act violation. When Pelosi meet with Assad over the objections of the Bush State Department Republicans claimed a Logan Act violation.

(17,199 posts)MALCOLM NANCE: To be quite honest, I am really stumped. I mean, this is unprecedented what happened today. I don't believe ever in the history of the United States has a presidential candidate, or anyone in the United States government, ever advocated for a hostile foreign intelligence agency to actually infiltrate or release data that they have stolen -- potentially stolen from a U.S. citizen or a U.S. government facility or server.
And then, to marry that up with the leaks that have happened this week so that they can get information out in a blatantly obvious political warfare/cyber operation that's occurring in the United States. It is Watergate with a cyber twist, as run by the Russian intelligence services. I really just cannot believe that any of this is happening.
