Before prospective jurors file into Courtroom 9A in the federal courthouse in downtown Portland Wednesday morning, the judge is expected to rule on whether the defendants in the Oregon standoff case who are in custody can wear neckties, belts and boots at trial as requested.

Ammon Bundy's lawyer J. Morgan Philpot argued that his client is innocent until proven guilty, and should be allowed to wear the civilian clothes that he chooses.

"We would prefer our clients not look like disheveled slackers in front of the jury,'' Philpot told the judge during Tuesday's last pretrial conference hearing.

Philpot added later in the day in a written motion, "These men are cowboys, and given that the jury will be assessing their authenticity and credibility, they should be able to present themselves to the jury in that manner.''

Ammon Bundy remarked in court that he's never even worn slip-on shoes or loafers before court on Tuesday.

IIRC, they're held either without bail, or with extremely high bail, since they're flight risks and dangerous to the public.

So yes, it's the judge's decision on whether to make them wear prison clothes, or let them wear a suit and tie.

I'm fine with them attending their trial in their prison duds.

. . .and gets to dress for the trial appearance, i think he should be able to wear the boots.

I would hope that the case is not so tenuous that the kind of footwear makes the difference.

The evidence is pretty clear.

Now, if everyone held in lock up awaiting trial has to wear the prison garb during trial, then he should too.

decorum and dress codes that will be followed. No hats is one of them,and they are asked to dress in Slacks and dress shirts. And a sport coat might be required.

also innocent until proven guilty and as long as their choice of attire isn't disrespectful, obscene or a distraction they should be able to wear what they choose to trial

People generally wear suit/dress shirts and shoes, or in some cases nice boots, I'm sure. So long as clothing isn't disrespectful or designed to make a scene in court, I believe the unconvicted are allowed to wear most anything they want. Most opt for dressy. I'd say a nice pair of boots would fit the description.

For the "Orange jumpsuit and sneakers!!!" folks, that attire is generally for the convicted.

Judge Brown .. ruled .. that there was no evidence provided that the Bundys' trial wardrobe would in any way suggest to jurors that they were being held in jail ...

She added of Ammon Bundy, "he's dressed better than most people in the building, period.''

"Let's get going folks,'' Brown said. "You're wasting time'' ...
