A new low in Florida -- adversely possessing a dead woman's property - by a commissioner.

There is a lot of sleazy activity that goes on in our communities that involves adverse possession of property. I've seen attempts to take over golf course property and very aggressive attempts to take over Association property. Some of it even looks like it's an organized effort among neighbors. If someone were to look into it, I'm sure that conspiracy and even racketeering charges would be appropriate.

But this latest case in Kissimmee -- this is a new topper.

Kissimmee commissioner arrested on fraud, grand-theft charges

Kissimmee City Commissioner Sara Shaw and her boyfriend were arrested on fraud and theft charges Tuesday after investigators said they moved into a home that continued to have its utilities automatically paid from the bank account of a dead woman who previously lived there.

After a yearlong investigation, Shaw, 36, was booked into the Osceola County Jail on charges of grand theft and fraudulent use of a deceased person's personal identification. Her boyfriend, Peter Sendtko, 42, faces the same charges and an additional charge of dealing in stolen property for allegedly selling the dead woman's car to his mother for $500.

Kissimmee police began investigating in September 2015 after the Florida Department of Law Enforcement received an anonymous tip about the couple living in a house on Mill Slough Road that was owned by a woman who had died four years earlier. The utilities continued to be paid by automatic withdrawals from the woman's bank account totaling more than $4,600, investigators say.

"In April 2014, the couple moved into the residence without permission and filed an adverse possession without color of title with Osceola County Property Appraisers in an attempt to establish ownership of [the woman's] residence," the FDLE said in a news release.

Her estate, of course, should have seen to closing her bank account. Her bank should have frozen the account, after learning of her death, which they would do if they pay attention to such things. They DO so in DC, I learned, upon my husband's death.

2. Adverse possession

The various rightwing groups encourage people to do all sorts of things, so we have people driving without a license or auto insurance, declaring themselves exempt from income taxes, issuing themselves passports from countries that don't exist, etc. Some of them think they can use adverse possession to do all sorts of magical things, and they're surprised when they get caught and spend a little time in jail.

in order to garner support during a very vulnerable time in our community's development. He managed to win a good consensus of people over who believed that the new developer would hand over the deeds to these properties if the residents on our side of the Association showed him support during the city review process. There was so many shady things going on during those meetings but every time the rest of us tried to start a discussion we were bullied and defamed into submission.

Well, the property didn't revert to them as they expected because the big reveal was that the property was legally in the hands of our Association, so the developer did not have the legal right to give them the deeds. Well, those who took the carrot must have felt cheated, because our association has devolved into a hostile community as these people have attempted every other means to gain control of these properties. Adverse possession is one of those means.

It is a story to tell.

Some hobo moved it, claimed to have been married to his mother and had a will and everything and even tried to list the property with a realtor.
