PORTLAND, Ore. (AP) — A judge overseeing the trial of seven defendants who took over a federal wildlife refuge in Oregon dismissed a juror on Wednesday after questions arose about his impartiality.

U.S. District Judge Anna Brown said she would replace the juror with an alternate and then placed deliberations on hold until Thursday, so the replacement juror could travel to Portland from central Oregon.

Defendant Ammon Bundy's defense attorney filed a court motion early Wednesday asking the judge to dismiss the juror over allegations of bias — or to declare a mistrial entirely. In court papers, attorney Marcus Mumford said the court had not adequately investigated concerns about the juror's impartiality, which emerged Tuesday afternoon in a note sent to the judge by another juror ...

... On Wednesday morning, lawyers for lead defendant Ammon Bundy filed a motion asking that the juror either be dismissed or a mistrial be declared.

"These issues aren't any easier to dispense of this morning than they were yesterday," Judge Anna Brown said.

The judge expressed concerns that no matter what actions were taken, there was a risk of mistrial. Asking the jurors if they had been influenced by the perceived bias of Juror 11 could adversely the work of the whole jury, she said.

Soon after, prosecutors agreed to the dismissal of the juror ...

... Prosecutors and defense attorneys in the case agreed to the dismissal of the juror, who formerly worked for the federal Bureau of Land Management, after U.S. District Judge Anna Brown said the juror would be questioned more closely about comments he may have made about his bias.

"It's a new jury, a new day, a new start," Brown said.

Brown said deliberations by the jury would start over. An alternate will step in for the dismissed juror.

The attorney for Ammon Bundy, the leader of those charged, asked the court in a motion on Wednesday morning to dismiss the juror in question and order the jury to begin deliberations again or declare a mistrial ...

If the Defense thought this would be grounds for a mistrial, he miscalculated. So did the juror who made such an amazingly stupid statement.
